insurance mistake

Default insurance mistake

I had someone drive into me about a year ago and it wasn't my fault,car was fixed and when the insurance sent me a cheque for my excess of £250 i put it in the bank,a few weeks later i got another cheque for £250 from my insurance so i put that in the bank as well.

I've now had a letter through saying they've paid me my excess back twice and are now demanding a cheque for £250 within two weeks or they will pass it on to their solicitors.

Were do i and the insurance company stand legally on this matter?

Is it a case of tough luck on them or can they lagally demand it back?

Anyone good on law here?

i'm no longer insured with them anymore as the claim was a farce on their side from the begining.

The money isn't yours to keep. Just pay it back.

hmmm ... normally with big companies like this a strong worded letter is all it takes... if you ignore it, then you will receive a letter from a collection company as it'll just follow standard process.

Most insurance companies are run by call center monkeys who really don't care and will write off a debt if you give them and cause for effort.

Would have been down to a human error which means sombody can be held responsible. They will try and get it off you first as of course they dont want to write the money off. Im sure if you decline they will make you an offer to only take half the money, then if you dont play ball, well sombody won't be getting the bonus this month

Think of it from another POV.

If you paid your excess twice by mistake what would you want to happen....

Treat those how you wish to be treated yourself, simple...now if they hadn't written to you it's a different matter.

play it out and see what happens. if they get really snotty give it them back minus £50 clerical fees.

Exactly. The banks get away with £30 for a computer generated letter. A deduction of £50 would be quite reasonable for the hassle, post and packing etc. and your administration time.
