Default 10 months jail for accident

Not sure about this - does jailing this 'decent' guy (judge's words) serve much purpose in this instance?

He fell asleep and killed someone. If it was sopmeone you loved he'd killed would you feel the same?

I think a custodial sentence was the right thing.

It wasn't a error of judgement, he was a sleep at the wheel.

There may be more to it, but it doesnt mention that he'd been up for 15 hours before starting work - that would indicate negligence/irresponsibility etc. He also seems to have now discovered a medical condition relating to this.

What do you think 10 months jail achieves? If he was properly culpable it should be life surely?

And just think...people have done the same whilst drunk, driving without insurance or licence, and had a mere due care/careless driving charge, and hence avoided prison.

I agree with the sentence, but I don't agree with letting other people off. If you are going to jail people like this then you need to be applying proper sentences for other crimes too.

Letting burglars and violent criminals back out on the streets time after time after time makes no sense. Assault should be jail time, let alone something more serious.

I think the man will suffer for the rest of his life for a mistake... a very bad mistake.

His mistake was thinking he wasn't as tired as he was.

I feel sorry for him and of course the family of the man he hit.

Jail will do nothing for him...

The fact of the matter is that he was a 'professional' driver and should have known more then most the consequences of driving whilst tired.

Does he deserve a custodial sentance? Well, it may just be a way of sending out a message to others who will consider driving when knackered.

I don't think jailing him will achieve anything other than cause more pain for him and his family. Tragic as it was, if it was a genuine accident his feelings of guilt may be sufficient punishment.

Would I think this way if he killed someone I loved? I don't know.
