Default DVLA trying to bully/thieve from me...

I sold a car to a German bloke who exported it straight to Germany.

I informed the DVLA and all was well, so I thought….. However, I received a letter from the DVLA saying I have not kept the vehicle registered and they wanted £80 (£40 if I paid quickly) as penalty for not keeping the vehicle continuously registered.

I sent them a letter politely saying I had told them and included proof – which I still have.

That was 2 months ago and nothing more heard. Until this morning.

Again, another letter saying I have ignored their ‘fine’ and must now pay £80 or risk the following:

The car in question clamped – it’s in Munich
A CCJ
Debt collection agency action.

Now, I am not paying a penny for something I am 100% not at fault for. Can anyone give any pointers as to my next action? Surely they can’t just send debt collectors round on their say so without evidence, or issue CCJ without me having my say and producing my evidence?

Any pointers as to my next move as they ignored my last letter telling them I am not at fault, and even producing the evidence.

I'd ring them. Its possible they never received your letter.

Be sure to keep a note of names and reference numbers aswell. I'm sure if a ccj is applied, the court would look at your evidence and be able to over turn it.

They did something similar to me, accusing me of not SORNing a car when I had.

Wrote to them to say check the date the registration doccy was logged by them as being received.

Not heard anything back after a couple of months.

Always worth sending anything like that by registered post. They can't deny receiving it then.

Dont give in to the bullies though, you say you have kept proof of sale etc. that should be good enough as well as the fact you informed them of the sale etc.

same happened to me. couple phone calls and i had it sorted. still a pain in the **** though.

Similar thing happened to me mate - you must lodge and appeal.

Nice one.

I'll at take it as far as possible and waste more than the £80 they are trying bully out of me by chasing/fighting me.

And they wonder why people don't bother registering cars properly.

I've just realised that the car was only registered to me as Mr *****. No 1st name.

With that in mind I have drafted this letter:

With regard to this letter, I have previously replied and icluded evidence that I DID inform you of the car's sale. You seem to have ignored this, so again I include it with this letter.

I am NOT willing to be pay a 'fine' for failing to relicense, because I did not fail to relicense - I sold the car, and informed the DVLA (as requested) of the car's export.

I will not be bullied by threats, and am 100% happy to attend a County Court, where I will produce a the evidence of my compliance.

You cannot simply pass any judgement and issue fines without my right to appeal. I realise most people just roll over for an easy life, but I am not one of your usual mugs and will happily go all the way as I know I right and am safe in the knowledge I have all the proof.

I am seeking legal advice and will be writing to my MP with regard to this.

Human error from your staff is the reason the vehicle wasn't notified as exported. I complied with your requests - I can't be held responsible for a DVLA staff memeber not acting correctly.

It's little wonder people do not register their cars correctly when you have this type of money-grabbing attitude to the law abiding majority.

I will not be corresponding to any further demands of money from you, but, as stated above, am happy to attend court or take part in any appeal process.

By the way, there are 3 Mr ****s at this address. Which one was the registered keeper of the vehicle? You didn't list a 1st name, and we all have different ones. We're all confused...........

You should add that you will charge them for every letter you have to write back to them, and when they realise they ARE wrong, you will want compensation for their wrong doing (postage costs, time etc)........ Boot on the other foot etc

I sent 'em £40 in the end after chattinmg to some DVLA woman in Brighton; well I was tired after winning the last long battle with the moneygrabbing state...
