Question Refund on net purchased clothes that don't fit

Sorry this has probably been done a million times.

But can somebody please confirm that if you buy an item of clothing online that doesn't fit properly, even though it IS the size stated, is the seller entitled to tell you to take a hike and do nothing more about it - no refund, no offer of exchange, nothing?

Don't forget that the womens sizes will fit different to the mens sizes. A classic schoolboy error for the novice transvestite.

DCI - it's an Ebay shop seller and he's just saying it's my tough luck.

Perhaps i could approach Ebay and complain? Although if there's no legal requirement on his part i doubt that would do much good. Just want to establish where i stand legally.

Unless there is a fault with the goods or their description its sold as described.... I've bought a coat off fleabay but tbh I would avoid 'clothes' for this very reason!

I hope you haven't spent too much, and would write this off to experience Tel!

Probably nothing Tel. A lad at w*rk has just purchased a 4 gig ipod equivalent from a seller on Fleabay, only to discover it's only actually got 2 gig, and the manual is so well translated into English that it refers to "vegetables" in several chapters.

He's complained, both to Ebay and PayPal, but there doesn't seem to be much that can be done. Even if you give them negative feedback, they quit and rejoin as a different seller.

IIRC purchasing off the Internet is akin to a Catalogue/Mail order purchase & so covered by certain sale of goods regulations ...one being that a purchased item can be returned & refunded for any reason.

Not sure where i read it though ...possibly on trading standards website

depends on what it says in refunds bit. if it in an auction then its tough - i would never refund something i had sold just because it doesnt fit as thats the chance u take on auctions and nobody would ever make any money as ppl wud say things didnt fit when they didnt like em etc.

If its a shop selling all clothes and has a refund policy you need to check if its based on if its faulty or not as described or even if youre not happy etc - which it doesnt sound like it.

the other option is of course to list it and sell it yourself - which is somethin ive done in the past! but unfortunately if it says they dont refund then ebay will do diddly im afraid seems harsh but i can see why too.

Ask for a replacement item/credit rather than a refund. They're probably pissed off with people buying on a whim or wearing items once before returning.
