pay rate question.
hello
my girlfriend has recently changed her job within the same place of work, she used to be a cash office worker and now works on the shop floor.
she has been on the shop floor for the last 2 months, just tonight louise' boss has informed her that her hourly rate has to be reduced and she must pay back all the over payment that has been made over the last 2 months.
firstly is this legal? if it is then so be it, not very fair or nice, but heh.
however if its not legal can you please prove it, so that we can throw it in their faces.

Union matter I would have thought?
Otherwise - if the new job pays less then she has been overpaid .... If she had been underpaid, would you want back pay?

It is very unusual for people to take a paycut when changing job role in a sideways, or even downward fashion.
I am not sure on the legal standings, but I have never heard of someone taking a pay cut before.
My advice, talk to CAB, an employment lawyer and HR, get HR to initally prove they are in the right. Do not just give up immediately as most often HR have no idea what the f k they are talking about!
Also I would be thinking about changing jobs as I see that as an unacceptable request.

WTF? We could go round and have a word with him..... Alternatively get your house insurance documents out; Zurich gives you access to a free legal advice helpline. They will be able to tell you exactly where you stand, if no mention of a reduced hourly-rate was mentioned then they cant do anything about it now though.

Same thing happened to a few unlucky folk at our place recently. Some had up to £350 taken out of their wages.
However, many are still in dispute and have legal bodies involved.
Unfortunately, nobody seems to know if it's legal or not
