Default Question on buying a company..

..My partner is looking at buying out her boss (Shes moving abroad) and when this may happen a girl that works there will be on maternity leave.
Question is does my partner need to keep the job open for her as its a buy out or can she tell the girl thats shes not got a job to come back too.

Remember when we bought a hotel - we bought the shares in the company that owned it so had to keep on the useless staff that were there. Ouch

She (the preggo one) is protected under TUPE (have a google for it), which is a safety net to ensure continuity of her employment should something like this occur....
