Default Working Hours?

Due to a work mate being ill I have been doing 12h nights for the past 2 days.

However my manager wants me to finish work at 5am today (Friday) then return to work at 1pm (same day) and work until 9pm. He then wants me to return to work at 5am Saturday until 5pm Saturday then 5am-5pm Sunday.

I dont know where I stand, im sure im allowed 11 hours rest between shifts can somebody please shed some light on this?

I usually work:-
Week1 Mon-Fri 0500-1300 Sat&Sun 0500-1700
Week2 Mon-Fri 1300-2100 Sat&Sun off
Week3 Mon-Fri 2100-0500 Sat&Sun 1700-0500
Week4 Off
Week5 Off Then back to Week1

Im on week one at the moment but I switched a shift with a week 2 mate so I did his afternnon shift and he did my early shift then we would swap back the next day (8h break between shifts) this is when the night shift man (week3) rang in sick.

What happens here is week1 man and week2 man cover him by working 12hours. This would have been ok but I ended up doing the nights and my mate doing the earlies as we swapped shifts.

I dont mind doing the quick turn around (8h between shifts) once but twice is taking the mick especially after 2x12 hour nights.

Is this legal?

Scott

PS Hope you can follow the jist of this **** about!

Wow! That's not simple! I would suggest that if you didn't want to do it, your best bet is to just say it will be too much for you, rather than start on legal statements!

Your boss won't be able to force you to do it, technically, and they should really have cover available for sickness, rather than rely on you working all hours.

Just try saying no, nicely..........

Working time regulations say you have an 11 hour break
