Default waa didnt know banks could do this

missis dopey as she is hasnt paid her c card for 2 or 3 months, she has a bank account and card with the same bank

she checked her bank account today and they cleaned it out of 190 quid


no direct debits set up for card payment etc they just took it from her, shes gutted now but spose her fault


i would never of thought they could do that

She must have set up a direct debit authpority to take full payment. Probably signed something on the form initially.

Hmmm wouldn't of thought they could do it. Maybe in the small print somewhere their is something that if she doesn't make the minimum payments they can take the balance out of any accounts held with them?

Some banks have "netting" provisions in their terms and conditions, allowing them to set off sums in different accounts or products if you're in default in payment on one of them.

Some banks don't have these provisions but do it anyway.

I'd ask them for a copy of the current terms and conditions for the products involved (i.e., current account and card) and see if it's allowed.

well shes going in tomorrow to close the account and open one up somewere else

I know with my bank any debts I incur with them are liable from the sum of my balance with the bank should they so wish.
So dont have cc with your same bank.
Agree will be in cc/account small print.

no not atall but you know what some women are like, shes also making another payment on her card but shes still cancelling the account incase they do it again

Definitely move the account. They should at least have the courtesy to write saying "If you don't pay then we will take funds from another account" (maybe they did). Anything in small print should be made clear before it is enforced.

there is an agreement in the CCA with halifax that states that they may take money from any accounts you hold with themselves if you fail to pay your monthly payments.

Halifax isnt the only one that do it, quite a lot do.

Sorry, but she'd be better having an appointment with someone that can show her how to be responsible with money rather than sulking and closing the account.

Its outrageous that people think they can borrow money but then not pay it back for months.

Absolutley not!

You agree to the terms when you take out the account, it should be made clear at this point I.e. read the terms.

If you have a late payment on a card they don't write to tell you. If you use a credit card cheque they don't write to tell you about the fee. The answer is no.

If they wrote to every card holder about every 1 of the terms you'd get dozens of letters.

im inclined to agree with many on here. she should have paid at least the minimum payment and i think its quite a good idea that they take the money from other accounts. bearing in mind she still has money left

No offence ,but if my missus had done that then the card would be getting cut up.
