Where do i stand??
Anyone help with yet another paypal/ebay question?
Situation is i sold my old broken plasma tv on ebay, quite clearly stated in the description that it was broken would not turn on and i have no idea what is wrong with it and there are no returns because it is broken and will be sold as such!
.... Chap buys it and pays for it with paypal.
.... He leaves good feedback before even collecting it.
.... Two months later ( after lots of failed collection dates) collects it from my house where he is more than happy, in fact he drove down from scotland to collect it!
Two weeks later, i.e today, i get an email stating he is not happy because the pixels or something are broken and the screen has a mark on it and he wants his money back
I have just told him to go whistle for it and feel free to contact paypal!
Am i in the right here or will paypal pull my trousers down like they did last time??
Any thoughts?

i have sold similar items, and i always make sure an email is sent to the purchaser, asking them to mail me back confirming they accept the item is faulty, with no warranty or returns, etc.

My exact words on the auction were :
This auction is for a faullty Fujitsu PDS 4222-E Plasma Screen/TV/Monitor. It was working fine untill about 10 days ago when it just would not turn on again! It is fitted with a black bezel because i used the silver one on my new unit. These are excellent Plasma's and not your cheap comet £1500 ones. These were best part of £5k when new. I have the remote but cannot find the instructions... i may well find them before the end of the auction. The unit is in good condition apart from some scratches on the back and i have lost a piece of trim off the underside that covers the buttons.... again i will try and find that bit! Collection only from Aylesbury in Bucks, Be warned it is very heavy! Also not that the carry pack that it is pictured in is NOT included in the sale! Any questions please feel free to ask, please bear in mind i am not a plasma technitian and do not know what is wrong with it!
And at the bottom of the ad:
No returns... it is faulty and will be sold as such.

I think he is saying that he has fixed the on off problem but there is a problem with some pixels and there is a mark on the screen
Amazes me that hes taken two weeks of pulling at apart to notice a mark on the screen!
It was not on there when it left here!

Well if for any reason i get it back i will let you all know Just so were clear ...... I think it now turns on but there is now screen damage and pixel damage

mate lets be fair it could have 20 dead pixels and you would be hard pushed to see them from 5 feet away. cant see his problem personally, you show me a place where you can buy a second hand plasma with a light mark on the screen and a handful of dead pixels for less than £200

I mearly pointed out that it was described as broken, when he collected it it was broken, when he got it home it was broken and now he cant fix it..... guess what... its still broken

I am not sure how many pixels he is taking about...He just said pixel damage in the email..... i know my one here must have at least 5 or 6 out but i can only see them when i put it on white screen

He bought the item knowing it was faulty, and as such the screen couldnt be checked when he bought it - he picked it up in person so had every chance to examine it for scratches and visible marks and reject it then.
If it really is just a few dead pixels then you can quite easily claim you had never noticed them while the TV was working, otherwise you would have mentioned them in the listing.
Basically, tough for him - as #19 points out, he bought it thinking he'd make a big profit, and didnt, and is now moaning to you.
I would advise him to stick it on Ebay and mention the scuff and the dead pixels, will more than likely get more than he paid for it.
Other than that he can take you to court, but theres a 95% chance he'd lose.

you should direct all his emails to ebay/paypal and tell him to discuss it with them as you are unsure of the rules- of course the rules will protect you but you dont need to get involved - the bloke knows where you lives and if he wants could be a right pain if he feels its becoming personal.

I think it might cost him more than £196 to take me to court! I find the whole thing amazing as i quite clearly said it was broken

Yep suppose your right Bloody amazes me that people expect something for nothing then when it backfires on them its my fault ... If he managed to fix the on off problem why cant he fix the pixels? and one other thought, would the on off problem have caused this pixel damage he is talking about?

Last time this happened i ended up £100 out of pocket and paypal tried to chace me for the overdrawn balance that they caused my account to have!

Tell him to **** right off. Plasmas are prone to pixel failure, something like a 50% chance that at least one pixel will fail during the first 6 months. It may even have been damaged during transport or when he was trying to fix it.

When i move mine i stick it in the special bag i bought with it, they tell you in the shop that they are fragile.
