Question for the 5-0 boys
Just read in one of the dailys, that photographs of actual drug taking, are not admissible in criminal law. Why not??
if that is the case, whats the differance between a drug offence and a speeding offence. (and dont state the obvious )
how can pictures taken from speed camera's be evidence aginst you, but pictures of drug taking cant??
surley if thats the case then all speeding piccys should be inadmissable?
comments please

I thought this would be quite clearly obvious - photo's of speeding cars show them moving between two points (lines in the road) and therefore a speed is calculated.
foto's of drug / possible drug taking, entirely no way of proving conclusively a substance was used. A substance that would have to be examined a checked in a laboratory to prove it was illegal. Where to draw the line otherwise? some boys takin pics on their fone pretending to be doin a line of gear when its only baking powder to look cool with their hoodie pals?

Thanks for the answers,
it seems strange that on the one hand photographic evidence is ok and on the other it cant be proven.
yet recent findings have shown that photograhic evedence presented (gatso) was flawed and incorrect,
interesting is the recent case where telemetry data was used to secure a conviction, it just seems strange that certain data is admissible and other stuff, which clearly could be isnt.

did you really say that????? theres a few very recent proven cases, that would disprove that theory

You get arrested for drugs, and spend time banged up in a cell.
Only for very serious and dangerous traffic offences do you get arrested.......

There could be many reasons
The person concerned could be diabetic and taking an insulin shot !!!!
The photos are only useful if, at the time the needle is seized, and the Lab confirm what it is.

Banging up drug users is a waste of time and money. There are loads more in waiting. The drug policy in the UK is NOT working, never has never will. If people want to do something, they will do it. Millions of drug takers and speeding motorists cant be wrong
