Default Accident pay out

Six months ago i was involved in a car crash and claimed for wiplash. I have just finished my treatment(suffered from backand neck pains) and been offered 1900 pounds. This offer was made over the phone, i got excited and took it(i had visions of shiny scooby bits, wife has visions of a holiday and paying overdfaft off!!)

I have been told i should have refused the first offer and asked for more. I have not signed anything as yet and was wondering if i have to take the offer they made on the phone. Is it legally binding?

Can i refuse and ask for a second offer or is it to late?

Ive known a few people who have been in accidents and had "whiplash", and theyve always been offered an amount, and accepted it.

Has to be said however the amounts have been larger than 1900 in all cases - a work colleage got 7000 for whiplash (about 6years ago however, so not sure if the payouts have fallen), and the accident was quite serious, but whiplash was his only "injury" and thats what he got.

There are 'Industry Standard' amounts these days ......

They are laid down and accepted by everyone .......

Not sure what they are - but £1900 for a mickey-mouse neck strain ain't bad and I would be amazed if it had a higher value.

Don't get greedy, take the money (after checking its the accepted amount) and forget about 'what could have been'

£1500 is the average, thats what i got,

they offered 1K to start, but after spending 5 days in agony and discussing with my brief, she advised 1.5k is the norm.

if you go higher, you then go beyond an initial inde quaks report, they then pull your medical records, and go through them (so the rugger injury that gave you a slipped disk will be seen) and they will then start to use the big guns to lower your claim.

its your call, but unless you had a slipped disk or serious injurys i,d say its a fair offer

Blagger my **** i could not work for 4 weeks and have been having physio(spelling) for 6 months. I was hit from behind while turning right. It was his insurance company that offered me a payout not me sueing them/him.

I'm more suprised it's only taken 6 months!!

Mine (genuine claim!!! - not saying that your's isn't though!) took 18 months to sort..........

I'd say that figure's about right - I settled quickly just to draw a line under it and get on with my life.

for what? whiplash?

if its a proper injury then fair play, otherwise get your greedy fingers the **** off my insurance premium!!!

Just yours ? what about mine, i have 3 cars to insure scoob@ 800 quid, mx5 @ 400 and a golf @ 500 so your not the only one paying out.

If you were offered money for an accindent would you say no? i lost 300 pounds on the car that was written off plus tax etc and only got sick pay for 4 weeks. So what have made? nothing just got back what i lost.

So it was whiplash then?

lol @ 6 months of physio! It's brass neck you've got, not sore neck! Hopefully your next accident will even things out a bit.

That is incorrect Pete. There are amounts which are what might be expected for an injury of a certain type but actual awards/settlements depend on the severity of the injury and the effect on the claimant etc.

My Girlfriend got £5700 about 4 years ago

Scaffolding Lorry hit her then a 4x4 hit the lorry and lorrry hit her here again

5 months of Physio and lots of talking

You Plonker, Never ever accept their first offer, my son was hit up the **** whilst waiting to turn right and got £2200, I on the other hand was hit by a drunk driver head on at over 100mph and got a lot more, mind you I could'nt walk for nearly a year, and have lost count of the amount of operations I have had

I've just had a settlement through from an accident about a year ago. I was sat at the rear of a queue at some lights on a motorway sliproad. After about 10 seconds of being staionary a nice lady in a Ford Ka decided ot come off the motorway, not slow down, and bounce off my car at 70mph.

The guy dealing with it at first (who was an idiot if ever there was one) offered me a grand from the off, no medical report, nothing. I politely declined saying I'd actually like to know medically what was wrong with my back/neck rather than me just saying it was hurting. Didn't hear from them for months (this is the person who hit me insurance company), then some other woman there got in touch (guess the first guy got the boot for being an idiot).

Sorted a medical report with my doc which was nice, first thing he said to me was he hates ins companies so it boded well.

Report done, he gave his prognosis of how long the pains were likely to last and they gave me a cheque for 2k, done and dusted.

So personally I'd say take it.

i got offered 1500 for my whiplash from my accident in october. my frineds afre in insrance and the told me not to accept. i might be getting around £2 now.supposed to have had a letter this wee though.

I would never accept the first offer. The fact they are making the offer is an admission of fault in itself. Are they 100% to blame? Was the offer made through your solicitor?

If you're having treatment six months later, that's a bad injury. I know there is the p1ss take element to compo, but if you were hurt, you deserve compo. Ideally you would rahter have not had the injury, but you may as well get something for it.

If you do not have a solicitor appointed to you by your insurance comapny, get one (not off daytime TV) you will not have to pay if you were not at fault. Contact them (through solicitor) and tell them on reflection you think that offer is insulting and they can write to you with another.

You are not held by the phone conversation.....

The insurance company for the other party have a duty to try and protect their shareholders, so they will not usually make the best offer straight away. Do you have legal cover? Have you talked to your legal council and got their input?

if this injury made u lose money by having to take time off work or pay expenisve rehab bills then fair enough. but this sue for nothing culture is crap.
