So after the Aussies kicked out a UK nonce at the end of his jail sentence and we took him back. We're now taking their Terrorists (suspected) as well? Seems the roles of 500 years ago have been reversed somewhat!

This may seem like a strange question, but how can the US justify charging a non-national with war crimes, just because he fought (however misguidedly) on the side opposing them? Surely this opens the door to them trying any ****** they like from anywhere in the world, if the refuse to toe the redneck line

That's pretty much how it works. The US are by default correct. Opposing them on the battlefield makes you a combatant. If you are not tied to the official army the US are fighting you become a mercenary or illegal combatant.
