Default Anyone hot on sale of goods act?

Bought a PSP about 12 days ago with a few games & found straight away that one was completely unplayable due to problems with the joypad. It's near impossible to hit diagonal directions with it & on further investigation found that it's a common problem with many PSPs. Also when I bought it they didn't have the game I wanted in stock but was assured they would have it for me in a few days time.
Went into shop at end of the following week & still no game in stock, so I tried to get my PSP swapped for a new unit but the cocky tw@ behind the counter refused & said it just must be me not being used to the controller.
I've found a way to fix this problem but am not exactly happy about taking my brand new PSP apart to fix it.

Anyone know if I can insist on a replacement? Gonna go into the shop tomorrow & will be very annoyed if they still haven't gotten my game in stock, can see myself getting into an argument lol. rather just tell him to stick it up his **** & get a refund or replacement.

Cheers
Jay

If its broken in some way then you are entitled to your cash back. If its a case of you not working it properly then no.

"fit for purpose", "merchantable quality" are the phrases for you to use.

Haven't taken it apart yet, trying to get it replaced 1st - that will be last resort.
Main game affected is Darkstalkers, pulling off special moves is pretty much hit & miss. It's so bad that if you are walking forward & attempt to forward jump, the character just carrys on walking forward - very annoying as it's one of the main games I bought it for.

First of all ask the spotty herbert for his name and write it down, then ask if he's the manager. If not then ask to speak to him. If he is then ask for the address of head office assuming it's a chain. Mention the sale of goods act and that you are well aware of your rights under it. It's at this point they'll probably just exchange or refund it to avoid the hassle.

Got a replacement turns out the cocky tw@ is the assistant manager. Got his name so will be complaining about him on Mon. He just couldn't make a decision about replacing it or not, manager took one look at it & said it's faulty.
New one is loads better, although still not 100% but as good as I can hope for I think.

Thanks
Jay

Just in case anyone needs the Sale of Goods Act info in future, IMHO there is a pretty good FAQ produced by the Dept of Trade and Industry at:

http://www.dti.gov.uk/ccp/topics1/fa...legoodsact.htm

HTH.

It is only the Sales of Goods Act and the Sales and Supply of Goods Act that makes any such return possible!
