Illegal parking fines
As some may be aware Robin De Crittenden recently appealed a parking fine on the basis that the 1689 Bill of Rights says that not just anyone can wander around handing out fines, it has to be done by a court of law.
Robin has won his appeal but, in an entirely expected attempt not to set precedent, the parking adjudication folks said that the reason he won wasn't because of the Bill of Rights (his only defence) but because of a "technicality."
With this in mind the intention is to appeal the decision (despite winning) on a point of law and so it is likely to go to the High Court, at least in the first instance.
This must certainly be one of the first cases of someone winning an appeal and deciding to appeal the win but the intention of the appeal is to clarify a point of law and to set legal precedent.
Their continued presecution/taxing of the motorist is certainly coming unstuck in a big way in this instance but any decision in respect of this also has significant implications for any organisation that tries to levy fines including the Inland Revenue who currently fine you for a late tax return.
