Default Speeding...What's the penalty?

I received a letter from the 'Traffic Criminal Justice OCU' today, saying 'Notice of intended prosecution'. I was doing 63mph in a 40mph. It was a brief pull away from the lights, on a clear road, as we do sometimes. Letter says there is 'technical and photographic evidence'. What do you think will happen? Thanks in advance for all your feedback. I feel pretty **** about this, especially as I drive within the speed limits most of the time.

My brother god done for going 85 in a 60.

£60 - 3points.

One of those mobile video vans.

What part of the country are you in? Here in Devon they've taken too blindfolding people and executing them, for anything over 20% of the limit.

Don't know about Lancashire, but i'm led to believe, old cuddly Ken livingstone want's to invest public money in a fleet of electric chair's for convicted speeder's.

Start reading Please don't just bend over and grimace. Cause as much hassle as you possibly can. Bare in mind that only a court of law has the authority to administer a fine of any kind. You have not been presented with any evidence which proves you guilty, only a document asking you to admit guilt. Insist on seeing all the relevent evidence, including photo's, video's, calibration certificates, operator training records (along with their names, rank and titles). Have a look at the video clip from the Inside Out programme which questioned the accuracy of the devices used and if you have the *****, take it to court, fight and possibly win. Although you may have broken the law, they might have not gathered their evidence correctly and that could work in your favour. The penalty may only be a small amount of cash, some points and their consequential effect on insurance, but the way traffic law, in particularly speeding, is enforced is shabby to say the least and if more people could be @rsed to fight accusations made against them, the burden on the legal system and the associated costs could worry the powers that be. If you had commited murder and they presented evidence as cr@p as that used to convict motorists there would be very few lifers in our prisons.

Whilst your upset over this, also please take time to update yourself with "ISA" (also here) and prepare whatever objections you see fit.

Forgot to ask, is your partner insured to drive your car ? If so, you can state that you both frequently drive the vehicle, and it is difficult to recall whom was driving on that day You may get a larger fine, but no points

i got done doing 62 in a 40 a few years back, they said if it had been 64 i would of had to of gone to court, so unless they've changed it you should have the option of fighting it or fixed penalty.

do you not have to go down the court route to gain access to any evidence against you?

You may get a larger fine, but no points
Failing to identify driver carries a fine of upto £1000 ( usually £250 ) and 3 points for the Registered Keeper.

I would always recommend fighting it, the police, cps often make errors in their paperwork which can be fatal to the prosecution case.

That's more than 150% of the speed limit... Probably looking at 6 points and a fine to be determined by the court. IIRC under 150% and it's fixed penalty land!

I was done for doing 65 in a 40 about 18 months ago...urban dual carriageways, was pursused by an unmarked police car for about 3 miles before being pulled over, everything on video...yes I was being a ****. I asked what the score was with the officer who stopped me, and he said there was a chance of a short ban because of the speed I was doing.

Anyway I got a court summons to which I pleaded guilty by post with some mitigating circumstances. Got 3 points and a £60 fine inclusive of costs, which I considered getting off lightly...maybe I caught the magistrate on a good day? When I phoned up the court to pay the fine with my bank debit card they thought at first I'd come through to the wrong number and said I needed the fixed penalties dept. The woman I spoke to was very surprised to discover that a fine of only £60 was being handed out by the court.

So personally if I was in your position and knew I'd been speeding I'd just take the rap, plead guilty and hope to get off lightly like I did. Yes you can follow the advice of people who say "fight it" or everyone should try to overload the courts system or to try to get off on a technicality. But chances are that if you do and you're found guilty the court will throw the book at you and you'll end up with 5-6 points and a something like a £600 fine plus costs.

And David Lock, they DO have the internet in Belmarsh, and all British Prisons. There are more facilities IN prison than there are in most people's homes, and you contribute to all the prison facilities from your income tax!
