Default Legal query, help please!

Does anyone know if there is any legislation which requires an employer to record incoming and outgoing e-mails?

There is no legislation that requires employers to read incoming and outgoing emails but there is legislation under the revision of the DPA that went through in 2002 I believe that gives employers the right to view employee's emails be they incoming or outgoing.

Yup - it's something along those lines. Is worded something like - "can look at them as long as the employee knows (which as long as they tell you they could do it at some stage is good enough) and if they believe the emails may be detrimental to the business in anyway - which covers a multitude of sins from selling company secrets (which you'd have to be pretty dumb to do on your office email) to anything that could be considered sexist/ racist etc etc.


I know someone who was sacked simply for receiving sexist emails because he couldn't prove he'd done anything at any stage to deter the person who was sending them.

Thanks, SJS. My girlfriend's employer has just told them that they were about to take this action in order to comply with legislation. It would appear that this may not be entirely accurate!!!

...although thinking about it, it could very much depend on who she's working for. Govenernment bodies etc may have different rules.

There's been a lot of legislation in countries all over Europe to allow data trawling after Sep 2001. Not sure what is compulsory though.
