Default Anyone successfully 'got off' a scamera NIP

If so how?

Tried pepipoo - sent the right to silence letter but gotta decide whether to pay up or try somethign else. Perhaps the PACE thingy.

Actual constructive advice required please, asap!

i got the letter, sent it back (signed) saying i couldnt recall who was driving....me or the wife (which was true)


they sent me the pic and said tough luck.....own up.


i wrote back and said......no problem, i am happy to pay your fine and take the points...BUT i want you to put in wrtting that its ok for me to alter the original statement (that i had signed) to now say i was driving. I was happy to do that but wanted written ok from them to tell an untruuth on the paperwork just so we could get it dealt with.

they wrote back and said dont bother.

I got off one last year by using the "unsigned NIP" loophole, but I understand that this loophole no longer exists.

Tiggs, did you say you couldnt recall who was driving by writing that on the NIP or a separate letter attached to it?

scooby...i answered your PM but in short...i wrote on the NIP "dont know who was driving" and signed it....thus they had to put in writting that it was ok for me to alter that statement once i said i was happy to take the heat....they decided not to bother!

i just wrote something like "I am unable to say who was the driver as i can not recall due to my wife using the car on the day in question"

then signed it.

i just wrote that in the space for the name and address (i put my name in print by my sig so they could see it was Mr Tiggs signing the thing)

I got a nip in dec 2000 , told em i didnt know who was driving as my wife n brother had access to car , my mother was in hospital with cancer and we were all making frequent trips to the hospital (all true by the way )
went to court
result
ms90 3 points and £170.00 fine


forgot to add was doing 52 in a 40 mph

If this goes outside of the 28 days and they want to take this to court can I still take the conditional offer of 3 points / 60 quid?

why will it take 28 dyas?

write to them NOW! and if you're worried about the 28 days thing ask them.

if you appear like a person who REALLY wants to pay the fine but is unsure how to do it when you dont know who the driver is they will be happy to help.

then ask them to confirm in writing that you can put false info on the NIP.

Filled out the NIP, they sent me a FPN (53 in a 40), I just ignored the FPN and they never did anything about it. If everybody followed this route they would only prosecute the people who drive at speed which are way over the top.

I did about 6 months ago. You must get it a maximum of 14 days after the offence ( or rather it must be posted 13 days after the offence, not counting the day of the offence so that a normal 1st class letter would get to you on the 14th day ). Mine was posted on the 14th day so it was not possible for me to get it after 14 days. It took two letters to them but after the 2nd one they conceeded it was issued "out of time".

So check the dates of the offence and when it was posted very carefully.

Well funny you should say that, I genuinely didnt get the original NIP, just a reminder letter on 5th Jan 05 (alleged offence committed 2nd Dec 04).

They just sent me a copy on the 6th Jan 05. Didnt keep the envelope though!
