Question Resigned from work

I handed my notice in at work in writing on the 23rd of Dec with three months notice should the last day of employment be the 22nd March ?

I am having arguements with our HR Dept as I have loads of holidays outstanding and I want to minimise the amount of notice that I work.

I know I could probably just walk out during my notice period but I don't realy want to burn my bridges.

I would say so, although some companies work on a 90 day nett system whereby it's the last working day of the third month. In this case the 31st March.

I would take it as 22nd March, then deduct any holidays owing or work until 22nd and get them to pay you the holidays (get it in writing !!)

You are entitled to holiday that you have accrued. You will also accrue holiday while you work your notice period. You are entitled to this holiday too.

just to let you know by law they can only insist they give you notice the same as your payment cycle - so if you are paid monthly you can get away with only one month's notice. 3 months would only stand up in court of the paid you quarterly regardless of whats in your contract !!

Actually - techincally you could get away with one week - there's been cases where it's been judged one week was enough. Not a lot they could do anyway (apart from sh1tty refs!). All they could do is take you to the small claims court - and that's pretty unlikely!

If they make you work the full 3 months they'll have to pay you the holiday time owed - as per your contract.
