Help! Done for 46mph in a 40
Tried search but nothing specific relating to this.
My son has just got an NIP for doing 46mph in a 40 limit. The Association of Police Officers guidelines say 10% plus 2 mph and you're okay, and only over that will you get done. My sums say he's okay, then (just).
Is this a mistake? Should he fight it?

I would weigh up the cost of a good lawyer v/s the cost of the rise in car insurance.
Is there not a UK website which specialises in this type of thing?

I'd say forget it m8. If the Police have proof he was doing 6mph over the speed limit then he was breaking the law. It would be worth fighting if the evidence was dodgy

Conrad, it was a parked van, presumably with a tripod-mounted laser inside.
To secure a prosecution, they need to have the calibration checked and recorded after each session, don't they? So if it was 1% out...

if it was 1% out then he would still have been doing 45.5mph.. still over the posted limit and probably less than he thought he was going..
I've just had a nip for 87 in a 70.. no quibbles.. bloody laser van hidden in the hedge bottom.. I was going faster than the posted limit I have to take the consequences..

A guy wrote in the newspaper yesterday IIRC that he was being done for 42 MPH in a 40 !!!!!!!!!!

Been to 5ive-0 and there is a guy who was in an idential position - 46 in a 40. Seems like the APCO guidlines are only that, and chances are it was a civilian doing the deed in the van who would be brown bread if he was caught not having calibrated his kit 100%.
They say it's worth asking N'hants Police of their interpretation of the APCO guildines, and the best bit is the guy in question got let off to attend a Speed Seminar. That would be a result

Just got done for exactly the same myself
I was offered, and have just sent off my acceptance for, the speed seminar instead of points & fine
Fingers crossed and your son may get the same, as long as it's his first offence.

Next time do 39, not 46 and he'll be safe.
Lesson learned? Maybe not.. guy in our office 3 years ago was caught doing 113 on the M62 - got 6 points and £200 fine, which he paid at a fiver a week
Just last week he got an NIP - 96 on the M74.. Some people NEVER learn...
46 in a 40 is harsh, but it's still breaking the law, allbeit a crappy law

Alright mate, long time no speak
I do have an excuse for mine though, i've now got a Pug 406 DT and the crappy speedo keeps stopping. Was actually in Hull where I got caught, on the A63 where the road swoops up & to the left before the ice rink round[square]about. I had seen the cop van at the side of the road and seen as the speedo had stopped I just kept going with the flow of traffic as I figured that surely no-one would be stupid enough to speed past the most blatant cop van ever! How wrong was I?? The van must have caught loads of drivers at that time.

Yeah, they camp around there - accident blacksopt you know.. I can remember... ohhh... at least NO ACCIDENTS there in the last five years
And watch out for the roadworks on the M62 around the A1 - theres a fixed gatso, and then they hide either a bike or a car with a radar gun further through the roadwoks, actually in the coned off areas and usually behind one of those massive signs advising you to keep left or right - they were there at 9:30 on Sunday morning ffs!

Suffolk plod have a policy of not giving out photos prior to a trial, so my asking confused them so much that after 6 months they dropped the case May be different in N'hants but worth writing for it anyway.

Not signing the NIP is not an option anymore. However, there is the option of not filling in the NIP at all - the "right to silence".

Some good info here. Always ask for the evidence. Ask for the calibration info and let me have a look. Some really bad people have got other family members to take the rap or even poor student friends, which is very naughty.

As i understand it, it's not that simple....sure you can keep quiet, the court won't mind, if no-one admits the offence or completes the NIP then the registered owner of the car is liable....it that's you, then the points will be on the way!
Is it really worth the hassle, you'll end up spending more time and money travelling to the court several times then the fine??!!
