Default Divorce advice please.....

....from someone out there that may well help please don't muppetize this

received a letter from my wife unsigned here goes:-

we have been separated for over 2 and a half years and I have decided to go ahead and apply for a divorce under these grounds.
I cannot see any reason why you would object, and that being the case I will pick up the costs of the divorce, unless you wish to make an objection, in which case I will wait until 4 years is up before proceeding with instructions.

I will be using a solicitor to apply to the courts for our divorce, so you will be receiving information through the post regarding this, I would appreciate it if you could respond to anything without too much delay.

As I said I can see no reason for you to hire your own solicitor as I will be asking for a divorce,naturally. This way you will incur no costs.

OK this letter was unsigned but the envelope was clearly recognised as her handwriting

what should I do????

any advice welcome, but as I have asked please do not muppetize

You don't have to do anything yet.

Wait until you get a letter from her solicitors, if you disagree or object then you can go ahead & employ your own solicitor (but they are costly as I know from experience).

If there are no children & no financial implications, you probably don't need one!

no children and judging by her letter no financial implications(as I asked her when she left) but knowing her, the letter from the solicitors will be on my doorstep tomorrow morning!

I will not be objecting, as I just want to be rid of her, but one Q I ask is :- should that letter have been signed by her and should I reply?

well, yes, she should have signed it (unless she just forgot - was there a space left for a signature?). An unsigned letter could be from anyone but if you say the envelope is her handwriting, then it's pretty certain she knows about the content of the letter. Does seem a bit odd though!


I wouldn't bother replying - just wait & see if you get anything from her solicitors.

i'd say the same.wait for her solicitor to write to you.her unsigned letter has no lawful obligation on you to respond to her.
I'd suggest to hire a solicitor if you receive anything from her solicitor.

I will get a solicitor when needed, but don't/can't afford a battle.
Prefer to keep it as simple as possible, but will not sign anything until I have seen one.

I'm sure I will not lose out as the last words that I said to her were "That if you take me for anything you will take it off my kids" and she agreed!!

Good luck mate - been there, done that!

Wait for the legal letter & plan your response from there. If you want good advice, you need to give us all as much data as poss - how long married, reason for split, who's kids ar they, ages of you both, both have jobs etc. I've found that once women see a solicitor, talk to their mates, all the good intentions go out of the window.

Hope it works out for you though, the relief of getting her out of your life will be worth it!

As far as I can see, she is offering to pick up the costs as long as you cooperate.....

Unless you are aiming for a reconciliation, why not just get on with it?

Divorce came through my letterbox this morning
very happy chappy
Thanks to Drunken Bungle ***** for the advice about form of consent, saw a solicitor and got everything sorted properly, we have no claims on eachother now or in the future.
