Richard,

Just for your information I have filed a complaint form about you to ebay. I assumed by your total lack of communication with me that you have either not sent the goods, or you never had the goods in the first place.

Also, the telephone number in your contact details is false, I called it, the person that answered had never heard of you.

This email was sent by an eBay member via eBay's email forwarding system.

If you reply to the email, your response will go directly to the member and

not through eBay.

eBay Marketplace Safety Tip:

If this email is an offer to sell you an item without winning the listing

on eBay, please report it to us at http://pages.ebay.co.uk/help/policies/seller-solicitation.html.

Please do not respond to it. Regardless of the apparent feedback of the

sender or any claims they might make, such an offer is not only against our

rules, but it is extremely risky. It is unsafe to purchase such an item through

a transaction that is not on our site. You will lose the benefit of eBay's

purchase protection programmes, and run the risk of losing your money.

Registered post gives a tracking number. Demand it and chase up the Post Office. Their response - and that of your seller to the request - should give a clue as to whether the package was ever sent or not.

It may be that the package is covered by postal insurance if you chose to pay for it.

I'm not that arsed about the money, its only a ton, the money I have saved and made on ebay will cover the loss If ebay play the game & cough up my loss I stand to lose about 17 quid on the deal , not exactly a king's ransom but thats not the point, this fcucker is trying to bend me over, and FYI mj don't bend ( ...not for 17 sheets anyway )

So I'll put it another way, what is the best plan of attack for this?

I'm just going through this with someone, fortunately i'm only £3 out of pocket. eBay will compensate you to some degree if the amount is over £15, i think you'll only ever see about 30% of what you're owed though.

You can report them to eBay for fraud, here's the email they just sent me when i did this for my to$$er seller:

Hello Iwan,

Thank you for taking the time to write to us with your concerns. I would
be happy to assist you further. I am sorry to hear that your transaction
with another user has not been successful. I realise how disappointing
this situation must be.

Rest assured the seller is no longer a registered user with the site.
Regrettably, as per eBays Privacy policy, I am unable to go into further
details as to why they are no longer registered.

Unfortunately, eBay's Standard Purchase Protection Programme does not
cover items of #15 or less in value (per item, excluding shipping
costs), however, this does not make the offence any less serious and we
recommend that you report this to your local Police Station.

If you choose this option, we will gladly help the Police with any
inquiries they may have. Please have the investigating officer contact
us through the UK Trust & Safety webform with the following information:

1. The case number
2. The officer's name
3. The officer's telephone number.

The UK Trust & Safety webform can be found at:

http://pages.ebay.co.uk/help/basics/select-RS.html

Similarly, should you wish to pursue this as a civil matter, your
solicitor can apply to us for any useful information at:

eBay (UK) LTD
UK Legal Dept
PO Box 659
Richmond
TW9 1TX

Please take a moment to read about our Standard Purchase Protection
Programme:

http://pages.ebay.co.uk/help/community/fpp.html

We regret that our Standard Purchase Protection Programme is unable to
compensate you on this occasion, but trust this information is helpful
to you.

We are committed to your online trading success.

Regards,

Austin Turner
eBay Customer Support

There's also a way you can launch a civil action against the seller, unfortunately i cant find the link to the website (it's a government legal website). It's pretty cheap and the bonus with doing that is they'll end up getting a CCJ which will royally f*ck up their credit rating.

I'd check for the link on my work PC but i won't be there for a week now.

Maybe someone else has it though...

goto my ebay

goto the item in question press payment status

get his name and address from there again, ring 118118 and get his telephone number, ring him let him know that the police are going to informed not ebay the police, explain that what he has done is theft.

if that dosnt work goto the police, you have a case for him to answer, a hundred pounds is a hundred pounds! its a lot of money you probably worked a day or 2 days to earn that money he has just taken it from you!

worst case scenario take a couple of mates pay him a visit and demand your money, be careful on that one, you dont who you are dealing with. by taking a couple of mates round I dont meen go and beat the **** with a baseball bat, he will probably ****e it anyway and give you the cash or the pda.

hope that helps.

If you look at my correspondence to him, you will note that I have already checked & obtained his details and have tried the phone no - surprise surprise, the person that answered the phone had never heard of the seller

After I filed the ebay complaint, I went straight to the feedback and left a negative for this guy basically saying " this person is an out & out fraud - you have been warned "

later that day I get an email from another seller ( via ebay mail forwarding ) that has had dealings with this con artist and has been stiffed for £23 aswell.

The Item I bought was £112, inc P&P, so I should see most of this back - but what a feckin carry on to get the money

This is why leaving feedback is so important.I had a similar situation where I bought something in USA for $500 plus shipping.I got most of it back as I paid by PAYPAL,but was still pi**ed to lose anyhing. This was after reading his feedback which was all good and not just cheap purchases to get rating up.

It would be the police for me. They love this kind of stuff because it's as easy to clear up as a gold-wheeled scooby past a yellow-top.

S1.1 The Theft Act (IIRC) 'Dishonest appropriation of property belonging to another with intent to deprive the owner'...constitues theft. There is no minimum value and £112 is a lot to many people. As a matter of principle, you should be one of them.

Many people's view of the police is negative, and I'm one. But when they get an easy shot for their statistics they're actually pretty good.
