Question Trees... and neighbours

What is the situation with trees and neighbours interests?

I do remember hearing something about Max height at 2.00m - there are people taller than that!

I was just having a chat with my neighbour this morning - we get on very well generally and he mentioned our bordering trees which obscure his sunlight in the late afternoon / evening. I am more than happy to try to keep on good terms and have cut the trees quite often, but he made reference to this 'new law' - saying of course he didn't want them that low, but would like considerably more than a trim!

It made me feel a little uncomfortable that he was making a threat here. Where do I stand in law? surely you can't be expected to cut every tree down to 2 m high if your neighbourobjects???

One of the main reasons I chose this house was for the garden and trees...

the new law he is referring to is to deal with high hedges. if they are *trees* rather than a *hedge* then it doesn't apply.

there is no right to light or anything like that so he will struggle to get anything done about it if you don't want to take any action.

he sounds like a trouble maker - i'd torch his house as a pre-emptive strike. best get your revenge in first, eh?

I guess it's the new anti-social behaviour act. Here is the section.

As PC says, it applies to 2 or more forming a high hedge, basically without gaps, and it specifies evergreens, so won't apply to deciduous (?sp).

Do 2 or 3 Leylandii stood side by side constitute a hedge ?

What is the best way to find a good local expert to give advice on tree maintenance?

errr...

yes.

if they are layland cypress then you might be better off doing something about them in any case - these trees will get seriously big (100' +) and once they are that size they are a PITA and very £££ to deal with.

whereabouts are you? part of the business i'm in does tree stuff, and it's my specialist subject

we are based in North London, Stevenge (Herts) and Ely (Cambs) btw.

I have a problem with my neighbour and his leylandi (sp)

Your neighbour is referring to the high hedges bill, which i don't think has been passed yet. If your leylandi's are planted against the fence to form a hegdge then they will fall within this.

Depends entirely on distance from his house / fence etc....

When the bill is passed, it puts the onus of hedge / tree maintenance on the owner (and a height of 6ft iirc)
My neighbour wants me to pay to keep his leylandi at a reasonable height ! And theres not a damn thing (within the law) i can do about it
Currently you have no "right" to sunlight.....

I'll have a surf this afternoon for more info....

Mick, if they are leylandii, top them religiously every year. If you don't, within 2-3 yrs they become almost unmanageable by DIY - partly due to height (taking 2ft off is OK but if 8ft you start to worry if the topping will drop on something and damage it) and partly due to the fact that you have to reach through the spikey foliage to cut the main stem.

Personally, I feel leylandii should be exterminated from the face of the earth, but I don't own your house (or one nearby) . I think I've removed 40-50, mainly from my parents' garden, and taken part in the destruction of a few more...

I wish I did. my neighbour has about 20 - 30 planted along our fenceline.

They were there when we moved in 8 years ago.

I'm trying to buy a small peice of the land off him so we can burn the horrible things.......

at least if that falls through I can rely on the law at last

Meddars - If your real name is Haydn - we'd best take it outside LOL

So if one cuts down alternate trees thus allowing light between them... No hedge TaDa !!!
I only have 2 at about 20 foot high I would guess against this particular neighbours garden and another one in the far corner about 30 - 35 foot high which seemsto trouble him too.

( also got 2 x sycamore and a spiky Rowan tree type thing )

Should've taken a pic of the hedge-cutter the farmer's just had round the back - thing like in the James Bond movie that sliced his BMW up on that helicopter - 'cept on a tractor
