hi

ages ago i posted a thread or 2 regarding a guy who ran into the rear of my car. his insurance company only offered 50/50 which i think is daft as in my mind he is 100% liable. my cover is only 3rd party so i decided to persue this via the small claims court. this is only for damage to the car, no injuries involved.

reading through the booklet today under "what is a small claim", "excluded claims"...

1. Claims for personal injuries
2. Claims in relation to a road traffic accident...

hmmmmm - so what the heck do i do now??? spoke to citizens advice and they said go the small claims court route?!?

i live in N.I. so i believe the rules and regs are different than the rest of the UK.

A mate of mine just went to the small claims court recently regarding an RTA so it must be possible. It was about recovering the costs of repairing the car only though, nothing to do with injuries etc.

A woman took me to the small claim court years back after she turned right across my path and I hit her car. I issued a counter claim for loss of Excess (fully comp) and won! NCD was restored by Ins comp...

This was in England...

i had an rta on a roundabout where a fella ran into the side of me trying to take an exit he was in the wrong lane for. that was in june 2002, my insurance company advised me to go 50-50. as i was in the right i said i wanted to fight it.
i got paid out this month, and got my no claims re-instated. my advice, if your in the right fight it.

S0dding insurance companies and their 50:50 settlements. Cant be of any help though, sorry!

i took someone to court here in the uk, was his fault, lucky enough the judge agreed with me - start the ball rolling.
