Tax disc ffraud

For once in my life I thought I'd done everything right buying my car - HPI, AA check, even my mate who works in Police control centre to check it all out - what happened?
The guy who got the MOT and tax decided to cancel the cheque straight after getting the tax disc - meaning, me the new owner merrliy sends his stuff away to DVLA for the new V5 - in it comes, then 3 weeks later in comes the DVLA letter requesting the return of the disc, and telling me I've been driving around illegally since ownership. However, they did acknowledge that the cheque wasnt presented my me.
Wonder what would've happened if stopped by Police, been in an accident etc?
Why are people so devious? Makes me well angry!!!!!!!!!
Now I'm down £165 and wondering whether to sue the git, or send round the local heavies to sort him out (hes a big guy and I aint).

Isn't the rule about 'causing or permitting a car to be driven' without tax? In that case, cancelling the cheque has caused someone (you) to be driving an untaxed vehicle, and is therefore an offence in itself. Definitely worth checking that one - BuRR?

If advert says 10 mths T&T how did he manage to cancel the chq ? when i write a chq out for my tax its usually cahed before my tax disc gets to my car, ok so its not that quick but normally cashed within a few days, so how did he mange to cancel chq 2mths on when money would have been withdrawn from his acct ?????

Would you be arsed for 165 quid,any normal person would simlpy had left the tax valid.........
PS not worth doing him in for that sort of money either.

if u try chucking a load of bread on the guys car bonnet and roof at night , sit back and enjoy as the nxt mornign that the car gets lots of peck mark dents as the birds eat the bread - ****s up the paint bodywork a treat......do so at your own risk......

Cheers for the suggestion guys, but i reckon the best way is the legal one.
Dazza the 10 months is what it says on the advert, he didnt put down the proper time which was actually not far short a year. He's paid for it by cheque, got the disc, cancelled it and slapped it on the car ready for muggings like me to buy it. The disc had not shown up on HPI check when I asked, as DVLA were requesting return/ or in process of requesting the disc to be returned. Pretty simple but effective.
Also cant believe someone would be so petty over £165 either - but thats the world we live.

I'd tell your mate to watch what he's doing checking your car on the Police National Computer.

That would explain it then, ok back to my previous statement, good smack and a tin of nitromorse paint remover, bloody brilliant stuff, u can watch it bubble and take the paint off right down to the metal.
