HELP!!!! Legal Advice (Speeding)

In September of 2001 i got caught speeding 83mph in a 70mph got 3 points, no problem as this was the 1st time i had been caught in 10 years of driving. But!!!!!!
In November of 2002 i got caught for doing a 105mph in a 70mph (at the world rally in Wales). I pleaded guily by post and it went to court on the 5th of this month. When i called to see what the verdict was they told me it had been adjurned to the 20th of this month pending disqualifacation.
I have spoken to legal advisors (not solicitors) on what the likely outcome maybe and keeping getting different info.. Basically i am after any advice on where to go from here and what the likely outcome maybe.......

over 100mph they can ban you immediately, on a side note though, I thought they allowed you 10% leeway (spelling is bad), in that case being clocked at 105 mph less your 10% = 94.5 mph.

with luck they may just give you some points and a stern telling off.

I am not condoning what i did, i know the speed limits aswell as anyone. Just after some advice that may help my situation.

When I got stopped for 102mph on the A34 near Oxford, I was summonsed too. I already had 6 points on my licence from two other minor offences, and didn't want to risk being just 'one Gatso' away from a mandatory totting-up ban, so I told the court I was didn't really need my car for work (I walked to the station at the time) and had shops, etc., within walking distance of my house, so a ban wouldn't cause me major problems.

I was banned for 21 days, and fined £200. The ban didn't affect my insurance the next year (the renewal was 2 weeks after the court date) and it's hard to tell in the following years ('99/2000/'01) 'cos premiums were skyrocketing for imported STis at that time, regardless of the state of peoples' licences.

I've absolutely no doubt that if I'd made a strong claim that I needed my car for work, etc., that I could have got off without a ban (just a hefty fine, and maybe 3-6pts). So I guess to a certain extent you'll have to play it however you think best. I would expect a short ban.

Having said that, I know plenty of people who've been stopped at much higher speeds and not been banned, and a couple who've had disqualifications at lower speeds.

a mate of mine was banned twice last year in his TT (I know, I was surprised it went that fast without messing up his hairgel as well!). 115mph on the M62 and 74 in a 40 zone. Got something like 10 days the first time and 6 weeks the second.

doesn't seem to have messed his insurance up too much - he's jsut been quoted £1800 for a 911 C4.

Thanks again for the replys guys,

When i got the first summons through i spoke to a legal advisor (through AXA Insurance) who said i could get a minimum of 6 points and a maximum of a 56 day ban.
Know i know i have to appear in in court i called again today and spoke to someone else who said it is possible i could get a MINIMUM of a 6 month ban. Would they class this as totting up?????

If it's a minimum 6 month ban, that sounds like a mandatory totting-up one. If that's the case, get some legal advice, quick!

Mate just got 6 months for totting up. All offences were just over the limit, he drives for a living and has a young daughter who goes to school out of town. Didn't have legal assistance though... not a good move.

Enroll on a advanced driving course. You can get the certificate within a week.
Show's the court that you've tried to mend your ways
May help.

My girl was doing 83 in a 50 (punto sporting), we used the duty solicitor at the court house (get there when the doors open and get in line first as once theve got a few juicy cases they wont wont to deal with your pety speeding case).

Anyway she got 4 points and a £60 fine (student)

Just curious - if you got banned, how did it not affect your insurance? If I got 3 points right now on my MR2 then I would have to pay a hefty ammount more.

This might not be the best place to ask. Prepare to be told that you are entirely irresponsible and will soon be getting intimately acquainted with Bubba. Could be you are getting conflicting information because the outcome will be decided by a person and is therefore not predictable?

Probably a short ban, I'm afraid. Attend in person and look suitably admonished. Friends who've researched it have always decided against an expensive brief as the outcome is subjective and sometimes attending with a brief can be inflammatory in itself. Take someone with you to drive you home. Good luck.
