Speed Camera Question
#2
I am currently challenging a camera trap, sadly the new laser type are appararently self calibrating each time they are switched on.
My challenge is based upon not having received the notice of intended prosecution within the 14 days allowed.
Sadly, if you are the owner, or have the owners permission to drive it, have a licence, MOT, Tax etc, then you are obviously able to afford the fine which is topping up the governments coffers.
If you drive a stolen car, or don't register yours, are pissed, no Tax or MOT. bald tyres, etc, etc, then you are seemingly OK, as the Police don't follow those pictures up. SUCH A FAIR SYSTEM EH!

Company car...got caught on the 23rd November apparently...I only found out today, but Work sent me a mail on the 18th December. Unfortunately I finished on the 17th December for Christmas. Got to find out when Work received the letter....
Apprently there is camera evidence, but it doesn't say what type of camera.
Cheers for the info...

OKay - apparently it was a portable camera that got me doing a 39 in a 30mph.
Can I request to see the calibration documents of said camera and how often should they have been calibrated??

Mice_ELF, I've obtained copies of the Code of Practice for the Operational use of enforcement equipment from the Police Scientific Development Branch of the home office (under the freedom of information act). The devices have to be calibrated every year BUT they also have to be tested at the commencement and completion of operations at each site by driving a vehicle with a calibrated speedometer at a pre-determined speed past the meter. You could also pay attention to the siting of the camera (is it near a metal fence etc...) and whether or not any other vehicles were within radar range when the reading was taken.
Contact me via e-mail for more info.

Just received the letter that Work got from the police. My alleged offence occurred on the 23rd November. Work received the letter on the 17th December. Is this outside the allowed time to receive a notice? Can I throw it out on this point?
Are company cars allowed a longer space of time in which to receive the letters?

They need to have sent a NIP to the registered owner within 14 days, but if this wasn't you (i.e. registered in company name) and the notice doesn't reach you until after the 14 day period it's still valid. I think you should be able to request a copy of the original NIP to check that this was sent within the proscribed time limit, but they can be a tad reluctant to come up with the goods.

Fleet have been good enough to send me a copy of the original NIP - it was written on the 16th December 2002. I was caught on the 23rd November, so they are out of their 14 day limit before they even wrote the thing.
Is this good news? Can I write a letter saying "Tough - your loss?"???

A505 Nr Evelyn Rd, Luton Road Dunstable is 30 mph.
One of our company vehicles was also trapped by the sneaky b*****d sitting in the central reservation, where you and I would probably get prosecuted for stopping!
There is a speed limit sign at the roundabout coming from Luton, not easily seen, particularly when you are looking at lorries and masses of cars during busy periods.
When our vehicle was trapped (Driver not known)there were no such signs, and there have also been repeaters plastered everywhere since.
Again, due to the revenue raising, rather that be pro active the police are reactive and make lots of money from it.
Put up bigger signs and most people will obey them, don't put them up and nobody realises it is a 30, not a 40 and up goes the revenue!!!
