Are there any traffic police on this board as I would like to lay to rest a debate which I believe is an urban myth!
Company car driver gets pulled over by Radar Gun!
Takes the fixed penalty at the time of the offence but offers not his own personal details but those of a colleauge.
Colleauge gets a summons to court, court try to convict, but he claims he was not the driver of the car.
The argument agianst is that I don't believe that the law can punish anyone if they cannot identify the driver of the vehicle.
I know there is a human rights debate over this currently but this is a different issue.
Can anyone shed any light genuine question I would appreciate genuine responses.

As an "ex" director of a company with lots of fleet type vehicles...
No is the answer because at the end of the day, if a company can't prove who was driving at the time of the offence, then the officers of the company (Directors) get the fines & the points
We were absolutely DAMN sure whenever there was a question as to whom exactly was driving that car at that time, no errors.
B'd if I'm taking the rap for some nOOb who never noticed yellow flourescent box on the side of the road or who got stopped at the side of the road
This included major arguments with plod when we could prove 100% (through vehicle tracking) that our car hadn't jumped the lights in Slough when in fact it was sat in a garage in SE London having major body repairs

there is / was a loophole about if they can't identify the individual in court.
ironically it was alex ferguson's son, darren who plays for wrexham that used it.
he asked for the case to go to court but only his defence turned up. when the defence asked the policeman concerned if he could point out the driver of the vehicle he obviously couldn't as he was not there so the case was dismissed

I just can't believe that at road side the police procedure is thta lax that they take no form of ID. Therefore any one can impersionate said other driver and take it legal and win.

I was burgled couple of months ago with a very good idea of the perpatrtors and the police have done little to pursue it. Just annoys me that the underfunded police are used as a Tax collection method. Annoying! how our money is pissed up the wall!

I dont think the police ARE underfunded at all .But lets face it the police and ultimately the Government dont receive a penny for catching a burglar but seem to amass quite a few millions in speeding fines ,hence the reason for cameras all over the roads of GB and not many in ya local high street watching for muggers
and to the "whos driving the car debate" wasnt it just a few months ago that a stock plod car was flashed going oh so fast and they couldnt find the culprit as there were dozens on duty at that station, and the chief came on tv n said he was "appalled" cos no one would own up wonder who got the fine n subsequent points ?
