My girlfriend just got a letter from a finance company saying they were the legal keeper due to unpaid HP and the guy she bought it off has moved to NY !
Anyone had this happen to them or know if we have any rights ?

If she bought the car in total innocence ,and was not told of any outstanding finance the car is legally hers ,and the finance house must chase the seller.Do not be forced by the company to hand over the car and put an anti theft lock on it.

Put a baby seat in the back Ive never repoed a car with one in,and never would.....

Unfortunatly,so far as I know,it is your responsibilty to see if a car you are buying has any outstanding finance,if it has money owed on it its your loss.Totally wrong in my opinion by the way.

Its only £25 for a hpi cheque which then guarantees you that the car is free from finance, insurance write offs etc.

True.......but a bit late in this instance.

I think its all wrong,you buy a car in good faith pays your hard earned cash,and some ****** hasnt been paying for it,then ***** off,its not on.

Finance companies should foot the bill for all HPI checks not the buyer....

My guess is that you are in the same position as buying a stolen car. The car belongs to the finance or insurance company.

I know this to be fact as I bought one by mistake once.

About 10 years ago I used to 'Escort' the gents who had to repossess cars - we were sad about the innocent ones, but, if the court doccie says repossess then thats what needs to happen. If I was you, make sure its not in sight - if you can. But we would take a look see to make sure we knew exactly where the ****** was to happen. HIDE IT is my best advice - but hopefully it wont come to that!

A bit ironic that Pete,all the bailifs Ive ever worked for have had a similar attitude to what Ive perseaved yours to be.

Are you a chairman of a society ie Lords Taverners of similar?

Do you have certain views that cant be changed,whatever.

Do you disslike large dogs

Do you enjoy serving writs.....

By the way all the bailifs Ive encountered have been pompuss cowards.

Thats ok Yoza - when I said 'Escort' I meant NOT as one of the suits, do you get my drift yet??? I was the one who stopped the angry young man from getting a bit rough with the suits!! I NEVER had any liking for the suits in particular, they paid my wage for those few hours and sometimes I got to drive the Mota home!! RESULT!!

Oh, yes, I have a BIG dog - laid right here next to me. Its a breed with a brain too - just how I like them

You CANNOT beat brain WITH muscle - run when you need to, stand when you can - but you get a chance eventually!!

Cheers guys, we'll speak to the finance company on Monday to find out the score.
It's all wrong in my opinion - if you have proof you paid for the car, have the log book, the car.... then it's yours. How come the finance company get to just sit back and say 'oh yeah, that's ours now' surely they should take responsibility for getting the money they lent back....

The other thing worth bearing in mind! ....how long was left on the agreement and before the sale to your friend was there any defaults in payments by the client? It might be a bit of work to get these details as they might (again I repeat) might be prepared to write the debt off. It can and does happen, but it does depend on the company who provided the funds.

Not forgetting that on all HP agreements, it does state that the person who took out the contract doe not have any title to the goods until all monies have been payed back...There are also different kinds of agreements a well. Its always a grey area and the best people to speak to will be CAB, who remain neutral and will try to win your corner if the law/rules will let them.

Personally I think the guy that sold the car wants slapping, its a liberty as well that we have to fork out up to £40 to hpi a purchase in this day and age. You would of thought by now that DVLA would put a bit more input into it and say posible mark the V5 for the next guys protection...
