122mph in a 60 what penalty?

My mate has just received an nip for 122 in a 60 and is wondering what ban/fine/points he is likely to get.

He knows it was wrong and is just after some advice so it would be appreciated if this thread could just answer the above question and not turn into the usual speeding debate cheers

A bit of background.It was on a bike in the middle of Wales (one of the legs of the EVO triangle for those that know it).Three miles from nearest village in the middle of a forest(trees either side and no junctions).He didn't see a single car for the whole length of the road and was video'ed(sp?) from a helicopter.His licence had previously been clean apart from a fixed penalty in 94.He is mid thirtys married with kids,and had just got a bike again after a gap of a few years.He has now sold the bike.

no seriously a 3/6 month ban and £300+fine could be coming his way!!!

I had one for 140mph on a Bike at 2 am over the Cat and fiddle in Derbyshire. I got 560 fine and 9 points but had to go to court to argue this as they wanted to ban me.

Ban and a big fine probably. If it affects his job, losing his license he needs to get a letter from his employers to say it will affect his job, good that he has sold the bike, bound to work in his favour. Needs to pay out and get a good brief IMHO. Just dont mess the court about. Theres a site called the speed trap bible which offers advice and has penalties issued etc.

Expect a ban definitely.At this kind of speed I think magistrates do not have discretion other than to ban. The length of the ban will depend on how well 'your mate' can prove he is dependant on his licence...employers ref/testimony should help....

a hefty fine will almost certainly be inevitable....just off the top of my head I would imagine a ban in the region of 18mths would be likely.....but I guess it depends on the magistrates...some are far stricter than others...fine will be dependant on his means....about 3 or times his weeky pay( as a rough estimate).....

Doubling the national speed limit..... not a good one m8.

I'd say they'd push for a short PRISON SENTANCE.

Get a VERY GOOD LAWYER ASAP.

definitely a ban and perhaps a quiet word along the lines of, what would happen if you came off, bearing in mind you are in the middle of nowhere, no-one about, no other cars on the road. DEAD. Looks like he has done the right thing in selling the bike.

Am not trying to criticise. This is exactly why I have so far resisted getting a bike. It is the 30-something age group that wind up dead on a frighteningly regular basis.

EVO triangle is made up of the B4501(where he was caught),A543and the A5 not far from Denbigh in North Wales

A policeman got a prison sentence for doing 125 in a 60 recently (which makes me [img]images/smilies/mad.gif[/img][img]images/smilies/mad.gif[/img][img]images/smilies/mad.gif[/img] ). Make sure your mate gets a very good solicitor!!!!!!!!!!!

Get a lawyer. References etc from an employer are no use on their own. You need to prove that other work colleuges will suffer unduly if you are unable to drive. For instance, if you are do 1 night in 3 on call and there are only 2 others who can do it and nobody can be recruited to do that job, then the other 2 would be punished by your ban and there is case president not to ban in those circumstances.

The other problem is that a custodial sentence is a real possibilty so even more reason to get a lawyer.

I got caught once in my early days coming back from southend in my xr2i down the a13. was doing about 120 in a 50 zone due to road works. Their were 3 of us one behind the other and we got caught by the old bill they reckoned they were following us for about a mile but none of us saw them, they pulled one of my m8s over. They told him to expect a letter through the post inc his m8s. Letters come through had to go straight to court, me and my m8 got a 7 DAY BAN PLUS £100 FINE while the m8 who got pulled over got a 1 MONTH BAN !!! how do u work that out. got away likley i think. it seems we got done by word because there was no evidence or nothing.

From the evo forum:

Can't he just deny it was him riding? They have no proof of who the rider was, only the owner. Refusing to identify who was riding is only a small fine IIRC.

Isn't it reassuring that the (North Wales) police, and their nice Chief Constable - Richard Brunstrom feel that it is entirely appropriate to use helicopters (which cost hundreds of pounds an hour to run) to catch speeding bikers/motorists [img]images/smilies/mad.gif[/img]

The B4501 doesn't even appear on their list of "safety van" roads, is normally deserted, and as mentioned above - has few sideroads. I myself have probably crept into the low 60s along there (but legally of course, due to speedo error )

I don't recall VASCAR marks on that stretch of road, so i doubt whether video evidence on it's own could be used in a speeding conviction.

You friend definitely needs a solicitor, but Brunstrom needs a good kicking [img]images/smilies/mad.gif[/img]

SELL HIS BIKE doubling the speed limit is an automatic ban and now insurance companies hate this type of driver and his premium will rocket quicker than his bike ever will and the funny thing is THERES **** ALL HE CAN Do a lawyer might get a smaller fine but by the time you pay him your even.

So much at stake here that it will be worth his while getting a good solicitor that is very competant in this area of the law. It would also be useful if it was a solicitor from that court area who was respected by the local magistrates.
Got to concur with others who wonder what on earth the police are thinking about using a helicopter that costs several hundred pounds per hour to fly on speeding details. Bureaucracy out of control and we live in a democracy.
Good luck with it.He will need it if the bench are anti-bike or think 120mph is outrageous.

my mate got 6 months in barlinnie for a 135mph in a 30 zone you take the risk you take the penalty when it comes! You are looking like a ban. or 9 points and a very large fine.

6 points, £600 fine, 28 day ban.

I got a 21-day ban and a £200 fine for doing 102mph on the A34 (a dual carriageway in Berkshire). So I suspect your mate will be getting a longer ban and a bigger fine, especially if his licence is already sullied.

Having said that, I'd decided to take the ban (rather than try and get away with points, and end up with 9 on my licence) so told the Magistrate that I didn't need the car at all for work or personal life. So if he does need his car, perhaps he might be lucky.

Cheers for the replies,I will show him this thread tonight.He doesn't need his licence directly for his job apart from the 10 mile journey each way

Somebody posted a picture of the road he was done on,I think it was Clarey but I can't find it.It has been in EVO mag loads of times though.

He is going to plead guilty and was in a very philosophical mood when I last spoke to him.I will update this thread in the near future.
