Court today....

Jeeze some of you lot were lucky - after 12 yrs clean license they threw the book at me with £500 fine and 6 points for 63 on a deserted country dual carriageway which was a temporary 30 zone unbeknown to me.. The policeman jumped out from a bush in the usual essex moneymaking style.
I would say it doesn't matter how professional you are or what you wear - if the magistrate is having a bad day, you're in for trouble...

Booooooooo plod got nothing better to do. 98 was a bit on the quick side.
I got done a few years back on the M74 Scotland - 99.78mph, got 3 points and a £280 fine. It does depend on your current record ie any previous etc and the County, but I wouldn't expect anymore than the above.

I was stopped for doing an average of 97.6mph for 2 miles (Vascar) on the M3 at Eastleigh, not long after I got my first Scoob.
Got a fixed penalty notice, and a 30 quid fine.

It was the Vascar that got me. Probably didn't help that I had 3 points fixed for 52 in a 40 2 weeks after the initial offence. I think that why I got the 5 points.
Oh well, it's speed limit for me from now on, cannot afford to lose license. It would probably result in loss of house, wife, car etc

Seems a bit harsh.
I got caught 5 years ago doing 97 on the M74 (in a diesel astra!) - got three points and £200 fine. Mate was done doing 98 on the M1 and got three points and £60 fine.

Hard to say whether it was actually harsh or not.
The Clerk and the Magistrate knew thier Scoobys though!!!!
I explained that the car was relativley new and I wasn't used to the speed.
The Magistrate asked what type of car it was. I replied and the clerk told him that I was faster than Police Cars!!
To which he replied, "not all of them!"
I kept my mouth shut although I was tempted to tell him that mine is

Caught by Vascar at 98.6mph on M74 back in '99 in a works Astra TD van.
The nice policeman in his leather clad Omega offered me a fixed penalty 3points and £40(?) fine which I gladly took.

You were lucky I think!!
Out of interest do they just look back at what Points you still have on your licence or will my total of 15points all go against me?
6 points current..
Mind you I have no intension of getting caught, I mean speeding ever ever again.. just wondered how far back a court can look at my driving history?

send your licence off if it has out of date points on it
dvla charge £17 for this.
when it goes to court the basts will look at your previous record (which is wrong in my opinion) and judge accordingly. So if you have only 6 points make sure that is all they see.
What I mean by this is...they don't have a record of what you have done in the past......only by looking at what is on your licence.
get them taken off

Erm..... what's Vascar? Sorry for my ignorance but I've been living in north Scotland for the past 2 yrs where the good old Gatso has yet to show its ugly head!

Under current guidelines - under <=95 is 3points + fine - >96 is 6 points + fine dependant on circumstances - 100+ is an immediate ban.
VASCAR is a very simple in car device that measures distance over time & hence speed - requires police to follow & track for at least 1/4 mile.
Chris.
PS - Sorry to hear you got caught - however - always look on the the bright side it could have been 6 points & 600 quid fine.
[Edited to add]
Corner - Screeech - hand-brake turn......
Sorry - Couldn't resist - I'll get my coat - which way to the muppet forum?

So they can only look at what is printed on the licence!!
Sounds like time to move house (pretend) again as the licence gets reprinted with address and they take off the points that are out of date and no charge!!
Or they did last time I sent it off.

Had an interesting chat with an English bloke living in France about their penalties.
The fines rise with excess speed, are fixed, very steep, and payable on the spot. Apparently, over 130 kph (80mph) on a normal (90kph) road gets your license taken away and you have to resit the test!!
This only happens if you have a license issued in France though, as this guy had got done, and just got the fine, no points etc, much to the copper's disgust.

amazing isnt it that the only offence where you previous record is allowed to be considered at time of judgement is speeding.
When trying someone for rape, the judge and jury are not allowed to know the defendents previous form...
still glad we have our priorities right

There seems to be a recurring theme on Scoobynet when it comes to road traffic offences. I'd just like to make a few points:
Firstly, current guidelines would mean that anyone who got 3 points for 95 in a 70 limit would be very lucky. It would be a departure from the guidelines but would be perfectly within the magistrates' discretion.
Secondly, disqualification for any one-off speeding, of whatever speed, is purely discretionary. Broadly speaking mandatory disqualification only follows drink driving, totting etc
Thirdly, previous convictions are not brought to the notice of magistrates until time of sentence. In the event of a not guilty plea previous convictions would only be declared after a guilty verdict.
Flame suit on

I currently have some points for something other than speeding..
So if I got caught speeding and it went to court would this be shown at the time of sentencing?
I guess it would so it cannot be just speeding offenses that are presented.. but all driving offences..
I don't see why you would need a flame suit CJ?
