Default tradesmen at your house/insurance question

posting this on behalf of a friend.

basically she is having some landscaping work done and the builder has damaged a drain under the lawn with his digger as he has been scraping it back,who would be liable to fix it?

i would have thought that it should be the builder and his insurance to fix it but she is telling me that he says its down to her as he wasnt to know there was a drain there.

any thoughts

Builder is responsible for any damage they cause, it isnt the customers fault the builder didnt do the correct checks, before driving the digger on.

As above. Householder is not expected to know where all drains/cables/pipes are.

Claim on your house insurance and let them deal with counter claiming to get the money back. If he is legit he should have proper liability insurance so it will just come off that.

I had some landscaping done earlier this year, and made sure they had insurance for this exact reason.
