Default Email privacy - offence to read others mail?

is it a criminal offence to log in to another persons email account and read their email without their pemission?

It's effectively an offence under the Computer Misuse Act.

"Unauthorised access to computer material"

Assuming that either the offender and/or computer/server the email is held on is based within the UK

It's a grey area. For example email at your company is not technically yours, you usually accept that in a disclaimer when you logon.

Would also be morally questionable to read someone elses email without permission ! This doesnt stand if its a work email account, as has been mentioned all work email is actually theirs not yours, and all Company IT policy states this now !

Shouldn't think so, the Police and other government organisations must do it for criminal investiagtions.
If your talking about someone hacking your Hotmail account and logging on as you I'm sure the Police have got better things to do then trace who it was.
