Infiniti CD-R's

Right, I am now in a battle with Infiniti over some recently purchased CD-R's that state they can write at 48x. My CD-R Drive is 48x and I am using the latest version of Nero Burning ROM. In Nero the CD's only register as capable of burning at 16x and no higher. Yet if i use some TDK 48x they show as 48x.
Its a bit long but here are the emails that have been sent to them. Does anyone have any idea where I stand?

Cakebox CDR's
However, despite the description on your website and on the packaging
stating that the CD-R's are 48x compatible and that my CD-R drive is
also 48x compatible, Nero burning ROM states that these CD-R's can only
burn at 16x. However, if I put in a 48x compatible TDK D-View CD-R, Nero
recognises this and says that I can burn at 48x. Therefore I can only
conclude that there is a problem with these CD-R's.
I have the latest version of Nero.
My PC is virtually brand new and very high spec.
Barcode is 5037430022840. If this helps?
These Cd's cost me a lot of money but they aren't doing what they say
that they should.
Any ideas?

Marc,
The CD-R and CD Writer issues of compatibility have gone on for years
and years. Our discs are 48x, and burn at up to 52x, however there are
always incompatibilities in different writers and discs. No disc does it
all for everyone.
Furthermore, firmware updates and different writing software can have
dramatically different results We can assure you the discs are fine

We would be willing to refund all the discs if they do not work at 48x.
However, we cannot at this stage ascertain whether they will or not on a
given writer. You have a specific writer, and if the media works on
other writers (ie our test ones) and not on yours, we would be inclined
to suggest it is a hardware issue.
If it doesn't work on our writers, you'll get a full refund. However, we
wouldd need to test them first. We can tell you, however, that in
previous tests, we have never yet found a media "problem" that was due
to the media.
If you would like them test written, we will need you to autograph 5
discs and send them to us, so that you know we are using your discs. If
they don't write at 48x, you will have your refund.

Thats fine but surely if a product doesn't work - regardless if it is
'meant' to - I'm entitled to a refund anyway. I have already stated that
another make of CD-R works fine with my system but yours doesn't. I'm
not questioning the integrity of the discs - all I am saying is that
they don't work with my PC for whatever reason. Therefore I'm entitled
to a refund.

We are not tying to be awkward. Our view point is that the discs DO work
- just that they don't work at full speed on YOUR writer. We know they
work on hundreds of others - and in any case they are rated, as is
usually the case, at a 48x max writing speed - it is not explicitly
stated at 48x max - but that is assumed - after all, people with a 24x
writer cannot expect 48x.
I will not be able to justify a refund - especially when they will work
in our test writers - a LiteOn 48x, and a Yamaha CRW-F1 at 44x.
They are genuinely excellent discs - obviously in this case you would
beg to differ. But the best thing you can do is find a discs that works
100% they way you want it to, and stick with it. It has always been the
case with CD-R and even more so nowadays with DVD-R.
We are not con artists - we couldn't sell 40million CD-R a year if we
were. We try hard to satisfy all - and we have offered to try and
convince you they are 48x media that work at 48x. I am at a loss for how
to handle this case without offending you and making things worse.
The discs are fine - in our opinion - they do what they were supposed to
do - albeit not on your writer - so I really won't be able to get a
refund for you. I know this is not the answer you wanted, and if they
were faulty, we would 100% send you a full refund - but in this case, it
cannot be done.

i would just burn them at the max speed you can.
and worry about other things in life.....
you can prove your point by not buying them again.
or getting a mate to try one and sell some to him, if they work.

Have you tried looking into if there is a firmware upgrade for your burner ?
In the dim and distant past I had a drive that would only burn at 16x on Sony CD-Rs. All other makes would only burn at 2x. Firmware upgrade later and everything burned at 16x no problems.
Worth a try.

Unless you specified in your order that they "must work with <insert_your_brand_of_CD_writer>" you don't have a leg to stand on.
I just ordered a new PC with an ATI Radeon 9700 Pro in it -- but the order form didn't state there was a DVI port on it. I know that these cards have DVI ports, but I specified it in the order just in case -- i.e. I have reason to reject it if it turns up with some sort of b4stardized card with no DVI port.
