I know what you're saying mate. It's quite possible, although the OP said it was an insurance job, so I can't see how it would be HPI clear.

If its a cat C, it should have a VIC pass marker on the V5 anyway. Cat D however wouldn't need the VIC check, so it's possible to hide the write off. Although it would clearly be stated on an HPI check, so maybe the OP needs to ask to see the documentation?

They don't have to say it's been repaired as long as the vehicle has been reinstated...people buy cars all the time that have been pranged on a dealer forecourt and sold without any recourse at law.


what is wrong is that if they say the car is HPI clear when it isn't (allegedly).........I'd ask for the HPI report.

That's an act of "Comission" and voids the sale.

If its been in an accident I'd demand a full refund immediately, if they refuse, do what everyone else is saying and threaten them with legal action!

Legal action for what?

A new car falls off a deliver trailer and trashed but can be repaired and sold "as new" quite legally......

I have done an HPI check and it's come back as clear so I think it was possibly cat d but not gone through the insurers so wouldn't come up on a HPI check as never actually written off.

I'm just wanting to return it but they are being a holes over giving me a full refund. As probably they have spent a lot of man hours and parts trying to rectify so giving me back as little as possible might help cover those costs.

I've spoken to the finance company and their complaints people are hopefully ringing me tomorrow.

I imagine it would be the finance company that would take legal action as technically they own the vehicle. Does anyone know if this is the case?

Hmm.. To return the car for a full refund you're going to need empirical evidence that says that they misled you.

The fact that they haven't fixed the issue despite trying does give you some room to breathe though, before you can get a full refund using the sale of goods act, you must give them chance to fix the issues, so provided they've attempted to fix and failed, that's more than enough reason to return the vehicle.

As for the damage, unless the car has been written off by an insurance company, you'll struggle to prove misrepresentation, as the dealer hasn't lied about it being HPI clear.

You need to get a list of facts together, and go from there.

The finance company done alot of the work with mine, basically I bought a car and the engine died approx 30 miles, as you can imagine I played holly hell over it but they point blank refused to act on it, the finance company who the car was with got involved and its fair to say it got sorted near enough immediately! Mine was within the first few days tho, but I would imagine they would have some course of action the can follow up
