considering the internals of apple products are made by samsung then apple is the same as Samsung

What is often confusing for people in these patent disputes is that often the legal action is over very small "technical" infringements, company's are very hesitant to roll out their most important patents to the legal battle field.

It was described to me like old style navel warfare where navy's where very reluctant to engage their capital ships - the desire was to only commit cruisers and destroyers hoping to inflict disproportionate damage to the opposing navy

The big guns of the battleships where kept back - acting as a deterrent

Deploying battleships was risky as they could always be sunk by lucky hit, or a perverse legal judgement

Apple are getting ridiculous now. So they won a case and are now overly confident by wanting to keep the momentum going by trying to ban the S3 and Note 10.1 before the iPhone 5 is released. This could back fire on Apple as more high profile court cases could overshadow the iPhone 5 launch.

It is going to get rather messy in the next few years, Motorola suing apple, Samsung daring apple to release an LTE version iphone which by all the rumours, would initiate Samsung to ask for an immediate ban on all LTE apple products.

Then, there is the Samsung appeal. The US supreme court might take all these cases and start an anti trust inquiry into apple. The patents system in the USA is in turmoil granting vague, invalid patents which companies then troll to stifle competition

I bet that if Apple ever got into financial difficulty, they would play the 'to big to fail' card and demand to be rescued.

I know they are losing market share with smart phones, but I thought they were totally dominating the tablet market?

Isn't that enough? What is wrong with healthy competition?

I don't think Apple will get into financial difficulty any time soon. Clearly they're not happy about losing market share despite posting massive profits that exceeds any of their competitors. "Imitation is the greatest form of flattery", but not according to Apple, they see it as a chance to litigate. Still, 1bn is a small price to pay in order to become one of the biggest smartphone supplier in the world in the space of a few years and helping Samsung generate $42bn in revenue for 2011.

I'm here, nothing new or interesting on is thread. There are thousands of people trotting out the same tripe on the internet.

If you need me to tell you how good Apple products are, I can do that, they're great. I have no care for the bigger numbers that Samsung are going to "kill" Apple with, bring back the minority days I say, the products were still good back then.

Samsung have had their slap, they should take it like a good company rather than encourage you Apple haters to stir the pot and feed the courts.

A good article. Apple may have simply awoken a bear, and it will stomp on them. If Samsung have to go in a new direction, they will still produce stellar products, and with the bad will that Apple are building for themselves right now, that makes for a very scary propostion.

Apple may have become a victim of it's own success. Because Apple's victory has set a precedence that "prior art" no longer has a bearing in patent trials in terms of design and "trade dress", Apple may have to either pay up or change their design of the iPhone 5 significantly enough not to violate the GooPhone patent.
