ok ebay in their wisdom, have refunded buyer but buyer has not returned item. Tracking number submitted false.

Anyone been in the same situ, what did you do next?

I would be sending ebay a very strongly worded email explaining you will be passing this on to your solicitor and not only going after the buyer but also ebay as they have left you in this situation and sided with the buyer who has committed fraud.

No, but I've been in more or less the reverse situation, where I had to return a faulty item but only had a printed and signed receipt from the PO as proof of postage, and Ebay steadfastly refused to accept this. In my case, the seller had originally posted the item to me with a return address label that was either for their old address, or was deliberately fake. Despite this, and despite them refusing to reply to a single email from me for weeks (once they'd given me their supposedly correct return address, in a different town miles away), or answer a single phone call (none of their numbers seemed to work, either off the fake/old label, or the one's on their item listings), Ebay eventually sided with them, and the only concession they made to me was to not mark my account with any penalty points. In the end I claimed through PO's lost mail system, and got my cash back that way (it was a £30 computer part, so below the threshold to need a tracking number).

I would try and get your case escalated at Ebay, so you can prove to them the tracking number is bogus. If my case was anything to go by, Ebay's internal rules are that they should absolutely not side with a buyer unless there's certain proof an item has been returned. If you can't get the case escalated, try and call their London customer care HQ (easy to find on Google).

My ebay account shows minus the amount the item sold for.

So basically he has the item plus a refund, I don't have the item to recoup money back and I now owe ebay the amount for which they keep sending chasing emails for.

I would a appreciate any help on this because I don't want the guy to get away with it.

In my experience, eBay (or PayPal) nearly always side with the buyer and there's not much you can do about it. Personally, I'd go down the route of proving that the tracking number was fake with the courier (or Royal Mail if it was them) and present that information to eBay.

Thanks for the advice.

Have submitted all info to ebay.

Luckily I have the machines serial number which I have passed to the relevant people so they can look out for it.

Also submitted an online fraud case too.
