I'm not saying anyone should follow what I say, but if I did take on clients, that would be my advice, then should it have a follow up from the litigator, a claim for instance, then it would easily be dealt with at that stage.

 

So what would happen if your neighbour or someone sat in a car outside your house managed to crack your network passcode and started to download stuff, how can the person that pays the bill be responsible for that ?

I watched the above on an IT programme not so long ago where i guy in a car showed you how easy it was to start using someone elses wifi network, he drove round different streets and pickd houses at random where he had access to their wifi network in less than a minute.

If the company is ACS:law, and your "work colleague" illegally downloaded **** or a Cascada single. Then its quite possible that their personal details are currently plastered all over the internet.

If thats the case and your colleague is on that public list, you can sue them under the data protection act

 

Our firms ISP was threatened with a fine for the illegal download of WallE on the NDS.
They consequently passed it on to us, never went through but put the wind up the person that did it

The actual details about that case will be made more clear in a few months, my guess, it was a default judgement because an arrangement was made between the two party's, a publicity stunt most likely.

The onus is on the litigator bringing the action to convince the court on a balance of probabilities that the person being sued is responsible for the infringement.

The phrase “balance of probabilities" is quite a big term used in civil cases and basically means, is it likely the defendant carried out the act, based on the evidence provided.

Improbable is the answer in most IP cases.

 

Just use a VPN and become completely anonymous, would be the easier way.
