Getting slightly concerned about discussing this now...
Basically the incident was near a different station to the one I live near so someone is coming out from my local station to take a statement from me as to what happened.
They will then pass this to the other station who will decide whether to prosecute me or not. If I don't mention some things in the statement that they are interested in and have gained from others then they will ask me about it. This is what I was told on the phone.
Also that I would be cautioned before hand.
I did nothing wrong, we all make mistakes and accidentally do something, hence they are called accidents... I am just hoping that by saying what happened they will see this and all will be fine.. failing that I end up in court I guess at which point I get a brief...
It is just a mass of hassle trying to decide how to word things so they sound okay.. and get accross what happened.

Be careful JGM, I've seen people persecuted (whoops - prosecuted) for crashing on a bend when they where well below the speed limit. They will point out that you where using inappropriate speed for the road conditions. If you mention the change in tarmac types, slippery roads etc, this could strengthen their case and do further damage to your's. I think you really should get legal representation for this

I'm afraid that losing control of a vehicle is not normally considered an "accident" in the eyes of the law. Think about what you said earlier, "you overtook a van, braked in a straight line and the back stepped out". To a policeman or a judge, that is a clear indication that you were travelling too quickly and possibly driving dangerously. Under normal driving conditions, cars do not fly off the road if you press the brake pedal.
Yes people do make mistakes and have accidents, but they usually end up paying for them.

They have already told you that they may decide to prosecute you, in which case I would want to be prepared.

If the other guy I hit, sorry bounced off the verge and into the path of... (getting the hang of this) was hurt then I would be feeling really bad and be willing to take all that is thrown at me...
we put ourselves at risk of changing someone elses life and there families lives everytime we get in a car.. but lets put this into perspective.. he was unhurt...
So I dented his company car... it happens so he was pissed off for a couple of weeks until they got him a new one...
Sorry but I don;t think that entitles me to go through all this sh*te and end up with possibly going to court and getting 3points plus the expense etc... or worse.
>>"you overtook a van, braked in a straight

It was a slight curve to the left and I believe I was still braking lightly as I turned the wheel... which is a no no if you are racing or hacking it but I wasn't I don't drive stupidly fast, if I did or had been then I would be willing to get what I get given... but I wasn't..

JGM,
I would say that the reason your tyre looked deflated was because of the accident.
The pressure of spinning or skidding etc can mean air escapes. Others may dissagree, however I have experianced this first hand on a track (not in my Impreza however).
Good luck and I hope it all gets sorted out.
CB
P.S. My brother did a similar thing a few years back. Hit a brick wall and bounced into an on coming car. The police turned up and took down the details. Whilst my brother could not prove it was not his fault (long story) the police did not take any further procedings.

JGM,
If you are seeing someone from the Kent Constabulary then I would think it was a wise decision to employ the services of a solicitor. As previously mentioned try going through your insurance (if you have legal cover). All you are doing at the moment is trying to pre-empt the situation and as we all know it's always "worst case scenario". One thing you can be sure of is you will have to make a statement and it's also true that what you say in that statement could effect the outcome thus it is important you get it right. Remember Dangerous/reckless driving or driving without due care and attention are serious charges.
Your solicitor will advise you of what you should or should not say he/she may even do this over the phone.
Terry
PS However in most cases including mine the police prosecution board very rarely take any further action.
