Snazy, I wish you the best of luck in getting your health sorted and hopefully finding some kind of way to resolve the situation you appear to be in with reagrds to your employer.

Personally I find it disgusting that your company is acting in this way and putting you in the situation where you have to make decisions that could affect your health and well being.

We just wouldn't stand for anything like this at my place of work and thankfully we haven't got to.

Cheers MrRA You have worded my emotions on the metter perfectly mate.
Going to have a meeting with my senior manager and the head of personel and see what they have to say. Next stop after that, a call to the solicitor.

Given the pain I have had in the past week, whatever happens, I think I'm probably going to have the op.

TT, I know where you are coming from, and used 20 days of annual leave after my operation last year, which I then felt cheated for. Taking holidays to allow them to do thingd that they had already had 5 months to do!

At the end of the day, if push comes to shove I think I will end up doing similar to what you said. Take an unpaid week off after the op, then just turn up at work unable to do anything for a few weeks.
Unfortunatley then the company are well within their rights to send you home and request a sicknote from your Doctor. This is what my ex-employers did after they discovered my ***** was "destroyed". Perfectly legal too it seems, as I had official grievances in, and 2 Union solicitors working on the case who couldn't get round this either. The companies stance would simply be a H&S one where you are not fit to do contractual duties (that term of phrase is used quite often ) and a re therefore possibly putting others/yourself at risk. Admittedly you're in a different work environment to what I was, but they'll have a line worked out. The only way IMO you can get round it is if the employers agree in writing for you to have a phased return to work.

From previous posts, it seems your employers are more tolerant than mine were, so just speaking from experience Michael. HTH

The people who actually know what they are doing have been very accomodating. Sadly a lot of the issues revolve around a manager who was just being an ****, and has now left.

With regards to dismissal for not being able to carry out my duties, recovery from an operation is not really a "condition" as such, more a temporary state. So I am pretty confident that that alone would not result in termination. I could be wrong lol.

With regards to the legal side of things, my employers have already accepted responsibility and liability for the previous situation, so I am on slightly better ground based on this. But far from untouchable.

I just want the damn op and not to lose out too much. Last thing I want is me mum stressing about bills etc, while im recovering. So as I say, financial loss is a last option.

Definitely sounds like you have a stronger foothold than myself. Your situation as you said is temporary which is good, mines permanent (won't go into it). So they would do well to dismiss you for something which has been diagnosed as repairable and recoverable (again something I don;t have the luxury of). Even better if they have admitted liability, thats the killer punch against them mate. This is what I'm currently persuing

Knowing the above, I would be fighting for full pay - especially if negligence on the companies part is involved. But your solicitor will be holding onto this deep in their claws

Solicitor is indeed holding them with the grip of a tiger right now, but sadly it all takes time. With the op 3 weeks away, its time I dont have. In the long run I can pursue the company to recover any lost income when I am off sick post op. But as I say, the money is needed in the now, not later.

In a perfect world, the legal case will hurry up, my employer will agree to some form of sick pay, and I will keep my job. 2 our of 3 will do for now lol.

Just trying to find out from someone when the rolling sick begins. Like Lisa said, it could be from the beginning of the occurance, and if thats the case, there is not a problem here at all.

Remembering if worst comes to worst, most of your creditors will agree to an arranged "arrears" for a short period of time. It's an option worth considering, depends how much you will get into debt by if you get stuck on SSP. Again it's something I can advise on as I'm in it myself with a few companies currently. CAB will help you if it gets to that stage. Worst thing to do is ignore it.

Phew, by all accounts I just got the green light. Good to go ahead with the op, full pay awaits. Naturally I will return to work ASAP

Thats a relief.

Payroll confirms the rolling sick year is from the START of the occurance, not the end as I was worrying about.

Thats the biggest load off my back in a long time.

Thankfully the one who has affected me most is thankfully gone now. So im glad to see things returning to normal.

Actually looking forward to the op. Now I just have to convince the other half to take a few days off, to get me home from hospital, and to make sure the dogs are ok for a few days as my wrist heals early on.

Glad you got it sorted mate. I can imagine with accuracy the relief you felt. It will give you the best opportunity to get it healed, something which I unfortunately will never know - boo hoo

Sorry to rub your nose in it mate. I hope you get whats due to you in the end, and get sorted out Will keep my fingers crossed for you, once I can feel them enough to cross them lol.

I plan on taking every second needed to recover to the best possible condition, and to hopefully end this crap with my left arm. Not gonna take ages, not like last time lol. But wont be back til I know im not gonna cause any harm.

It has indeed been a day of relief (no not like that lol) Got a holiday insurance claim sorted too, so its been a nice positive day. Lets hope I can keep the momentum.

Don't be silly, I would never accuse you of that. My situation is a long drawn out one that may see me close to 30 years of age before it's sorted. I'll worry about it then, and concentrate on myself now

I am now awaiting confirmation from HR to determine if I will get paid. Lets see what happens now. Probably turn it all on its head. But if it does, my manager will have some questions to answer.
