Snazy, I wish you the best of luck in getting your health sorted and hopefully finding some kind of way to resolve the situation you appear to be in with reagrds to your employer.
Personally I find it disgusting that your company is acting in this way and putting you in the situation where you have to make decisions that could affect your health and well being.
We just wouldn't stand for anything like this at my place of work and thankfully we haven't got to.

Going to have a meeting with my senior manager and the head of personel and see what they have to say. Next stop after that, a call to the solicitor.
Given the pain I have had in the past week, whatever happens, I think I'm probably going to have the op.

Totally agree Dave, that's why I am happy to work with them to stay on side so to speak

At the end of the day, while I know I'm not legallý obliged to anything, so have no expectations. However in the circumstances, I don't thing its unreasonable..
TT, I know where you are coming from, and used 20 days of annual leave after my operation last year, which I then felt cheated for. Taking holidays to allow them to do thingd that they had already had 5 months to do!
At the end of the day, if push comes to shove I think I will end up doing similar to what you said. Take an unpaid week off after the op, then just turn up at work unable to do anything for a few weeks.

The people who actually know what they are doing have been very accomodating. Sadly a lot of the issues revolve around a manager who was just being an ****, and has now left.
With regards to dismissal for not being able to carry out my duties, recovery from an operation is not really a "condition" as such, more a temporary state. So I am pretty confident that that alone would not result in termination. I could be wrong lol.
With regards to the legal side of things, my employers have already accepted responsibility and liability for the previous situation, so I am on slightly better ground based on this. But far from untouchable.
I just want the damn op and not to lose out too much. Last thing I want is me mum stressing about bills etc, while im recovering. So as I say, financial loss is a last option.

Knowing the above, I would be fighting for full pay - especially if negligence on the companies part is involved. But your solicitor will be holding onto this deep in their claws

Solicitor is indeed holding them with the grip of a tiger right now, but sadly it all takes time. With the op 3 weeks away, its time I dont have. In the long run I can pursue the company to recover any lost income when I am off sick post op. But as I say, the money is needed in the now, not later.
In a perfect world, the legal case will hurry up, my employer will agree to some form of sick pay, and I will keep my job. 2 our of 3 will do for now lol.
Just trying to find out from someone when the rolling sick begins. Like Lisa said, it could be from the beginning of the occurance, and if thats the case, there is not a problem here at all.

Phew, by all accounts I just got the green light. Good to go ahead with the op, full pay awaits. Naturally I will return to work ASAP
Thats a relief.
Payroll confirms the rolling sick year is from the START of the occurance, not the end as I was worrying about.
Thats the biggest load off my back in a long time.

I plan on taking every second needed to recover to the best possible condition, and to hopefully end this crap with my left arm. Not gonna take ages, not like last time lol. But wont be back til I know im not gonna cause any harm.
It has indeed been a day of relief (no not like that lol) Got a holiday insurance claim sorted too, so its been a nice positive day. Lets hope I can keep the momentum.

I am now awaiting confirmation from HR to determine if I will get paid. Lets see what happens now. Probably turn it all on its head. But if it does, my manager will have some questions to answer.
