As this was all getting out of hand i decided to look through the receipts and see if i could find a bit out about the car, which i did, i managed to find the previous owners phone number so gave him a ring last night, he seemed very nice and never had a problem with the car, all work was put through the company so whatever it needed it got as and when as the company paid for it, its only got 2 owners and the one before him was his cousin so he knows the full history of the car, after speaking to him i am at ease so to speak,

i think this is simply a case of the garage not actually knowing whats wrong with it rather than the car being a dud, i do believe that the head gasket has in fact gone and will be getting it checked when i get it back,

if it has gone then i shall tell them to repair it, if it hasnt gone and the radiator blows again then i shall be taking your advice and getting out of the agreement,

so we will see, am going to give the garage a call now and see if we can have it back yet

Ouch, sorry to hear of your problems!

I'd really advise getting a 166 point RAC vehicle check done with any future car purchase. It might be £200 or whatever, but it'd bring any potential problems straight to your attention before purchasing the car.

Surely the big thing we are all missing here is that the garage has provided a warranty when they clearly are not capable of actually repairing the car it was provided for, surely this is time to get trading standards involved?. Its a bit like me selling dvd players and offering a warranty when I can't fix them, if you bought one and it broke you would expect me to get a proper service center to fix it which is what the garage should have done by now. I don't personally believe that any garage is incompetent enought to just keep replacing radiators without trying to find the problem first, sounds to me like they are fobbing you off. If they are that icompetent they should definately not be selling warranties for cars like a scooby.

Thanks for that, i think thats exactly what they have done, they have given a warranty on a car they know nothing about and now its gone wrong dont know what to do,

Anyhow we are getting the car back at 4.30 tomorrow so we arent going to drive it tomorrow night, we are just going to take it straight to hdc in hebden bridge saturday morning and get him to give the car a check and make sure its ok

If i remember my consumer law correctly regarding vehicle purchase, if a vehicle fails with the same fault three times then you are entitled to a full refund or replacement, which ever you choose. I would check with trading standards before continuing with ownership of the vehicle.

Thanks for your reply, i have researched on the net about it and if we do have to fight then it would seem there are 3 different laws that we can fight with, the only problem is that we never actually got any paperwork for the warranty ouch i know we should have got it in writing but we didnt think at the time, and i get a feeling that it will hinder rather than help if we ask for it now, all we have is a verbal agreement regarding warranty, he told us how much we said yes and he stuck the cost into the finance but it doesnt state that it is for warranty work

Regarding the car, we didnt get it back on friday, the garage said that the radiator had been fixed but he wanted to send it to another garage to get it full diagnostic checked before we got it back, he said we can have it back tomorrow but hasnt rung today so whether we do or not is still to be determined

I have however rung the finance company today as they stopped looking into it cos the garage said it was down to our driving style why it had broke I have told them that 4 months on we still havent got a fully functioning car, still havent got the log book, and still the negative equity on our old finance hasnt been paid off, so the finance company are reopening the investigation and have asked us to call them back tomorrow to let them know if we got the car back ok

my mate had a similar problem. he changed the heater matrix 3 times and it kept on blowing. the car was like a sauna!

in the end it was something to do with an incorrect aftermarket header tank.

... and eventually with contiued overheating the head gaskets gave way.

Pleeeeez don't let this put you off subaru's. These are beautiful cars. Just misunderstood by many

Don't worry, we aren't put off with the car at all, hence why we are sticking by it through the tough times (and boy these past 4 months have been hard ) we want the car back and aren't going to quit until we get it back, hopefully then it will be worth the wait and we can enjoy too

cos at the moment we are on our 8th courtesy car and i can tell you this.......... they aren't any fun

I would definately contact the financial services authority FSA (I think its them anyway) as a couple of years ago the laws regarding selling waranties got really strict, and I mean in a go to prison if its wrong kinda way. I would think selling a warranty without paperwork and putting it on the finance agreement would land you in some serious hot water.

Hiya,

Yes thankyou for asking, we have now had the car back for just under 2 weeks, and (touch wood) everything seems to be going fine, have had it checked at hdc subaru in hebden bridge (nice guy and knew his stuff) and all seems well, we have now done just short of 300 miles so this is a big improvement on the measly 15 miles last time lol, the radiator that they have now put on is a dull silver rather than the really shiny silver that they put on last time (you know the silver, it just looks cheap) so hopefully all will now be fine,

have just fitted a blitz bov and hayward & scott backbox here come the mods

The garage, they could get into hot water because the laws regarding warranties are really strict. If they have not even provided paper work they haven't done the job right, they need to provide you with an invoice and T&C's for the warranty. I seem to remember that if the warranty was put onto a finance agreement the laws are a tighter still.
