I've now waited 3 weeks for the labels (still waiting actually) and they wouldnt give me an extra month of live, only offered me 3 rubbish games or the livevision camera.

Apparently my service request become locked, and they had to escalate it to the tech team which took 3 days to look at it, who deleted my request and told me to ring back in 2 days to raise a new request. Did that today and they told me they are going to raise it to escalation team. I told them to post the labels to me, but apparently that would take a long time (5 days). Its only taken 3 weeks to get nowhere. Absolute cr*p

I could have waited a few weeks and got Forza cheap, not on the day of release at full price. Only played it for 2 hours.

That is ridiculous So frustrating as there is nothing you can do. How hard can it be to instruct a courier to send out labels ?

I actually felt sorry for the last bloke I got on the phone I did explain that I wasn't annoyed with him, but the whole unacceptable situation.

Why can't you have the labels emailed and then print them, Mine turned up in 2 hours after the first contact.

Yep, this is what happened for me as well.

Wish I'd realised they were offering free stuff though - all I got was an offer of a free repair even though mine was 2 months out of warranty. Might try and call them for an update on when the thing will be fixed and get a free game or two while I'm at it...

Thats what I requested and has taken 3 weeks to get nowhere. The email with the label details needed to be released and no one could do this. Though everytime I phoned they told me they had released it.

I'm so pi**ed off with M$ at the mo....

More annoying that its raining, cant do anything I want to do outside so stuck indoors with no xbox

Well after the hammering mines had doing the ScoobyNet F2 Trials has resulted in my 360 freezing almost everytime I race in Forza 2.
No artifacts, no Red Ring of Doom, just freezes mid race

I just bought my second 360 after getting the red ring and code 0020 on my original. It started as now and again but envetually became terminal.
Seeing as I already opened the case before it failed (fitted a wisper fan and Black Knight case) I can't return it under warrenty so I followed some online instructions on how to replace the ****e x-clamps holding the heatsinks inplace, a few cooling mods and the dead 360 lives

Gamers on the forum are not going down quietly. In another thread entitled “Was the massive thread about xbox freezing deleted?,” one user writes, “omg? You see, they don't *** care about us. All they want is money. I demand an explanation! What a bunch of ******. Screw this, i'm phoning MS.”

In yet another thread, a user says, “I've decided to make a thread to try to get an actual count of people who've had their Xbox 360 die since their Forza purchase...” Within minutes, more gamers have begun posting away with their problems

Now I don't get the ring of doom but now I'm doing the longer races my 360 just locks up solid. Is it worth me trying to return it?

Got up this morning, thought I'd give F2 a go, played for 20 mins before it froze.
Turned it off, restarted the xbox, put in Crackdown and played it without any hint of a problem for 1.5 hours.

I just wish it woud go if it's going to, rather than leave me in limbo!

Mine did this for a few days before the ROD, it does seem that alot of 360's are going down on Forza 2 though...is it too demanding graphic wise and so generating too much heat !!!!!!!

Any that crash take them back to your retailer and demand a replacement as unfit for purpose sold and unmerchantable quality. MS will get the message qwhen retailers decide not to sell these or get so many back they'll have to have some sort of quality control

Resellers by law just have to deal with faulty products within the first 6mths. But if the item has an inherent fault since day one then you have 6yrs to get the unit repair/replacement via either the reseller or manufacture regardless of warranty. However the responsibility is down to you to prove the unit has an inherent fault - you just can't say it has one

So what does this mean? Basically Comet is within their right to direct you to MS for warranty repair since you have had the unit for more than 6mths.

In your position, due to the poor design of the unit. You could threaten to take MS to a small claims court and claim costs back without the fear of incurring legal bills. From past experience manufactures will give in 9/10 because the cost to defend the case would out way the compensation but most importantly, if the case was lost it would open the flood gates for more claims against MS.

Simple steps to take.

1) Contact Citizen Advice Bureau and Trading Standards for Advice. You can contact Consumer Direct but I have found them to be rubbish at giving correct, impartial advice.
2) Telephone MS support to inform your unit is faulty. If they inform you the repair costs is £80 etc then object in a calm manner and say you’re not happy with the situation because based on friends/reports you have read, you strongly believe the unit is of poor merchandise design therefore you reject to pay any expense to get your unit repaired. If they refuse, which they will do, then request to speak to a supervisor because you are now going to take MS to small claims court under the Sales of Good Act based on goods unfit for purpose.

Important. Do not accept crappy games or free accessories because as soon as you do you loose your rights for a compensation claim – Main reason behind MS giving free goods away

3) No doubt MS will still not back down. You can either; stand your ground and proceed with the court claim without getting the unit repaired (best course of action) or repair the unit (object costs by written letter) and then claim costs back. If you stand your ground, then the rewards would be fair greater than the latter claim. In theory, if you unit isn’t repaired and you proceed with a claim. You could purchase another 360 and include the expense in your claim because you could put forward in your case that you should not be put in a position to not be able to use your accessories (i.e. games you have brought, steering wheel if you have one, kids suffer etc) because of MS 360 being unfit for purpose.

Good luck and let us know know what happens

By the way, after three weeks I am having trouble with my wheel as well, the gear-change paddles crunch and squeak like mad when in use which is really irritating. Apparantly this is a common problem as well which proves that MS aren't just shipping dodgy gear with the console!!

N-American Retailers Estimate Xbox 360 Failure Rate High as 33 Percent
From dailytech.com:

In an effort to gain a more accurate picture of Xbox 360 failure rate, DailyTech decided to poll retail outlets that sell the Xbox 360 and with it the option to purchase an in-store extended warranty. Out of all Xbox 360 extended warranties sold, we wanted to know how many were claimed by consumers with defective consoles, thus giving us a more accurate failures percentage.

After contacting several retailers from various regions in North America, the responses were unanimous: the Xbox 360 is the least reliable gaming console in recent history. Current EB Games or GameStop employees who offered information did so under strict anonymity, as it is against company policy to reveal such information to the public. Furthermore, our sources confirmed that EB Games revised its Canadian warranty policies during early 2007 for consoles solely due to the failure rate of the Xbox 360.

EB Games held conference calls for its Canadian stores informing them of the new policy changes and revealing alarming failure rates of the Xbox 360. "The real numbers were between 30 to 33 percent," said former EB Games employee Matthieu G., adding that failure rate was even greater for launch consoles. "We had 35 Xbox 360s at launch I know more than half of them broke within the first six months (red lights or making circles under the game discs). Two of them were dead on arrival."

The failure rate nearing a third of all Xbox 360 consoles was found at other retailers too. A Best Buy customer service department manager, who wished to remain unnamed, said that failure rates for the console were "between a quarter to a third" of all units sold.

Aparently there a huge thread on the xbox.com forums that got mysteriously vaped with 900 people claiming that Forza 2 is causing their 360 to freeze.

25 days is shocking - mine have been away for 7 days, I'd be asking MS for compensation, at the very least you'll get an extension to your Live subscription.
