Paul,

I had a similar problem when I had to come back to the UK (after living abroad) to see my Grandfather before he died of cancer.

When I got back up to Middlesbrough I found that a certain letting agent had let my house to a pair of Grove Hill Smack Heads. Nightmare. I couldn’t believe it when I inspected the house, it was an absolute tip. When I left a year ago everything was brand new and the house was in perfect condition…

Now all sorts of things went through my head, things to do to these people, half my mates (who work the doors in the area) wanted to go around and sort them out, etc. I lost plenty of sleep about it and actually drove round there with a baseball bat at 3am and sat outside the house contemplating going in and doing some real damage. In the end I rose above it all, I’m glad I did now.

I'm telling you now, forget about all these crazy ideas and suggestions and go the legal route. It's not worth the hassle mate. You could end up selling your house to pay these ***** compensation for unlawful eviction/harassment etc. Unfortunately the law is on their side...

I was fairly lucky, after issuing them a second notice of eviction they left in the end. Unfortunately they stole all my white goods and left the place a complete dump owing me over a thousand pounds in rent.

To tell you the truth I couldn't give a **** about it, I've moved back in and spent the past 6 weeks redecorating the entire house from top to bottom. Its cost me a couple of grand (replacing cooker, washing machine, fridge etc) but it's all done now.

These things happen, such is life and all that. Don't get worked up or lose sleep about it, it's not worth it. See a solicitor and go the legal route, it might take a while, it might not, who knows?...

Remember, it could always be worse...

This is just an update
seen a soiciter and basicly there is nothing i can do if i do the none violent eviction i could end up paying this tw@at 19k in compo and yes i have seen proof of that

on the upside the blokes been round mine and payd this months rent
he said last month he was using up his bond, hopefully he will leave next month as he said

I have had a few problems with Tenants and it does get you worked up .
At the end of the day though if they have been in a while and paid your mortgage for some time then just take it on the chin and accept that some people are like this .
I have had sleepless nights plotting revenge etc ,after receiving no rent for a couple of months and then after finding the place empty with rent owing and the house a tip **** ,but with prices rising as they have recently ,then you should still be in a more favourable position after the heartache you are going through .

A little down the line you will think ,its all part of lifes rich tapestry !

Glad you went to see the solicitor, as I only just saw this thread and you are indeed liable for massive payout if you throw him out. Its a percentage of your house value or something, so 19k is on the low side for total costs if it goes down like this

This guy, imo, is playing games with you. I went through a similar experience a while ago. To get the guy out, you need to act now with the correct legal notices. You have to apply to a court to get an eviction order. There is a fast track route that gets your house back, IF you do not wish to ask for compensation from the tenant. If you want compensation from the tenant, it takes a lot longer.

Imo, you take the short route, you want his *** in court as fast as humanly possible. Forget any compensation, chances are low you will actually get it.

There are games tenants can play, like not paying rent one month, then paying the next. This slows your legal process down, and means they can stay in your house longer.

If he takes it to the wire, and you do everything properly at best speed, you are looking at about 6 months to get him out. That will be rent free for him, and you will not have applied to recover any of your costs.

The longer route will let you get your costs back, but you may be looking at 9 months if the tenant plays his cards correctly. That is, the tenant, pays just enough money to stay stay there, or even shows up on the day of the court appearance and gives you Ł200 in front of the judge as a gesture of willingness to pay....my tenant tried that crap.

When you get to court, you also need to start to arrange bailiffs....sounds like this guy is going to make you use them.

You really need to get the best legal advice you can get your hands on. I would suggest more than one source. Each and every action that you have to take in terms of giving notices you need proof. I would suggest hand delivery of all notices, photographed, with the current days paper in hand for proof of date. Everything must be witnessed, and photographed. You have no idea what your tenant is going to claim you did not do if they go the whole nine yards.

I'm sorry if I am giving the full negative, "OMG you are not going to sleep post". I just want you to cover the avenues so that you don't have to wait any longer than you have to.
