Well to me it reads like you've let the Scoobynet scaremongers put the frighteners on you and jumped the gun a little.
Comedy sales tactics aside.
Personally I would of taken a slightly different approach and had an independent inspection done (not that I'd need it but it costs a lot less than £500) Then concentrated on the CAR rather than the dealer, seeing as you were already £500 down, if the report came back with issues then it would have given you a reason to back out and have your deposit returned, in so doing you'd have cut your losses to less than half of what they are now, if the report came back all good then you would of had the "peace of mind".
Ok they have a bad rep re after sales service but they do get some good cars through their hands, CupraJakes Spec C being a perfect example, by the sounds of the advert this one looks like a good un to me and they already had your money so in for a penny and all that, also you test drove the car so you must of had an idea as to whether it was ok or not before you put your money down.
I'm sure mine won't be a popular view, but if you think about it everything else that has put you off the car has been related to peoples views on here, non of whom have seen the car in the flesh nor dealt with the company in question.
Also to be fair to CP it's only understandable that they get shirty with you after you tell them that you've heard they're **** from people on here and want your money back on that basis.

Ok, so in theory...
If they are considering this as a commitment to buy/secure deposit (which it wasn't given no contract etc) then should they have taken the car off the market? As nothing was signed and there was no timescale agreed on completion of the transaction, I assume that I have as long as I need to decide whether or not i want the car. During this time, it can't be sold in the meantime whilst they hold my deposit? If it is sold in the meantime then they are in breach of the "commitment to buy/secure" deposit?

Maby give the car another chance. I know its overpriced it ALWAYS will be at a dealer but as others have said white newages are rare as rocking horse poo so you could see that (and not loosing your deposit) as worth the extra premium.

Also 500 pound deposit is so excesive it makes you think they have probley covered there tracks and have stung people before that have change there minds or couldnt get the funds!

The only receipt I have is a visa printout from the card terminal and an invoice (no T&C's, literally a piece of paper with their logo on it).
The invoice isn't signed by either party and the handwritten description doesn't mention non refundable. Purely states its a "deposit to secure" the vehicle. No time limit was discussed nor mentioned on the invoice.
Appreciate peoples opinion who think I should get independent report etc but as I have mentioned, I do not want to do business with them. I want piece of mind from a reputable dealer. That is something that they can't offer in my opinion.

I'm pretty sure I saw this car being advertised a few weeks ago on PH by the private owner and to be honest it sounded ( the advert) like a nice example. If you left a deposit on it then you must have been fairly confident regards to the car and happy with the condition.
As suggested get an Inspection carried out and ask for the brakes / tyres to be replaced or discounted off the price (as long as nothing else comes up in the inspection) and then happy days IMO ..
As previously mentioned concentrate on the car rather than the seller..!

Why wouldn't they sell the car if you've told them you're not buying?
If I was in their shoes I'd pay you back, but if I was in your shoes I wouldn't expect my deposit back.
To expect them not to sell the car after you've told them you don't want it is unreasonable imo.
Sorry if this sounds harsh, just my opinion.

However I feel a court will probably judge what constitutes a fair price for this given the short space of time between you paying and backing out. With this and unless they gave you any specific terms and a receipt I think you stand a good chance to get something back. Also in your favour is they have been to court at least once recently and lost.... they may not wish to do so again and if they do their previous judgement may sway things in your favour even though they are probably not really allowed to consider previous offences.
I still think you need to get some idea of what they think the deposit is for by a roundabout method and then take a view.

Thanks guys. On the basis that the car is advertised with "0 modifications" and as mentioned above, it clearly does have modifications then the case could be argued that the car isn't as advertised?

If he was so serious then they have another buyer lined up and they should have no issue handing over your money. That is is exactly how I would put it to them.
Stop trying to look for get out clauses, man up and get your money back by being honest.

Very likely to be the case. The insurance was astronomical as it was. I wouldn't be able to afford it if I was to declare the modifications. So there we have it, a reason as to why I can't proceed with the transaction.

3 month warranty is the law so no matter what they'll have to cough up for repairs sooner or later should the worst happen, as they have already discovered.
Like I said you only don't want to deal with them now AFTER the way things have gone as a result of your actions which were as a result of this thread.
I saw your first few posts and you were over the moon and excited, now your p1ssed, only thing that's effected that is you came on here and allowed yourself to get sucked in.
Twice in 1 week, sit back relax and take some time to think things through without letting your emotions get in the way.
Reality is there is NO reason for you to lose £500, only stubbornness and pride.

First off... What is the point of a Deposit if you can then turn around and change your mind and ask for it back? It kind of defies the point... So I don't think you have much hope of saying I have changed my mind and want my refund back...
But... Because you have nothing in writing, who is to say what the agreed period of full
Payment is?? Is it 6 months time, 10 months time etc etc.. They won't hold off selling it for long so that could be your get out of jail card..

It's the nothing in writing that I feel is my strongest argument. Along with the car not being as described. I'm not trying to return the car after purchasing it, just want a deposit back.
Can they justify a £500 payment to cover 1 hour of their trading time?
My wife's friends brother owns a car garage and is very familiar with all the governing laws and regulations etc. He's going to give us the lowdown tomorrow.

A happy customer from CP is a rare thing but I guess they are out there. You are pulling out because they had you over a barrel and only we made you see that.

You just said that insurance was astronomical. So much more than you thought yes? I only mentioned the petrol thing as these cars rarely get much past 20mpg, on jungle juice vpower too.
How much the insurance going to cost you anyway? I can't see the odd light and strut brace adding much. Is your age a big factor?

If they have to start using a lawyer to start seeking advice etc that £500 they are holding will soon seem like nothing to them and they will buckle on the first hurdle...
One day they really are going to **** off the wrong person like that guy who had his car robbed during that Subaru trade and ended up going there and smashing all the guys house and cars up lol
