And as he has said, there some other points that he has yet to share, I expect due to how embarrassed he might be by them.
I'm the first to laugh at myself when I make ***** up. But now the OP is trying to justify pulling out of the sale due to a tinted light or two and a strut brace? Just be honest. You got stitched up and you want out. No shame in that!
I just worry about comments like 'astronomical insurance' ......after he gave a deposit over.

Let's be factual please. The petrol cost? Come on, I made a mistake yesterday. I've accepted that. I'd rather you weren't personal about things.
Scoobynet seems to be a great place and I'm absolutely kicking myself for not doing adequate research first.
Facts are I test drove the car, paid a deposit and now want my deposit back. I understand that if I had signed a contact or some T&C's then it would be game over. I didn't sign anything, haven't commited to anything and I'm looking for suggestions to help me get some money back. Would you turn your back on £500 to a company like this? That's a set of tyres!

sorry to hear about the outcome at least you no what type of company you was dealing with.
if they be like this about giving you your deposit back can you imagine what they would be like if you had a big fault ..

I got stitched up - I want out. Your spot on. Your advice on page one was "walk away". That's what I'm trying to do, but I'm not going to just turn my back on
£500.
Don't worry about my insurance costs. I'm just looking for factual help that may help me get some money back.

Yes you should of got terms and conditions but I'm sure they will be typing up one now woth all sorts if nasties on it
Forget all the get outs like high insurance ,petrol costs ,strut bar no mods wtc and pressure to buy and a mystery buyer
Of it went to small claims court you woke lose as judge can only look at the facts ,not the character of the garage ll
As you have confessed to changing your mind on a forum that is now against you
If you had kept quiter and paid and got a independant report you night have got a chance but now a judge would think you could if bribed and independant so it probably would not help your case against cp

You haven't been ripped off at all, the dealer has a bad rep but as you haven't actually taken possession of the car and found out its a dog then I can't see what the problem is.

You haven't been ripped off at all, the dealer has a bad rep but as you haven't actually taken possession of the car and found out its a dog then I can't see what the problem is.
My advice - Walk away, lose your £500 and put it down to experience, even if the car proved to be ok, you will never be 100% happy.

I agree that you really don't have a leg to stand on in court and this is why should accept defeat in that YOU made a **** up, not them.

Really sorry to see this mate,it's massively unfortunate you didn't know what these muppets are like. As one of the mugs who bought a car from CP and the many threads and legal action going on I feel your pain. I've got my fingers and toes crossed for you,they lose in court and STILL give bad customer satisfaction...unbelievable.
If it's the car I think it is,it looks to be a good un but it was for sale for 8k so CP probably got it for low 7k but purely on the fact they got their grubby hands on it,see it as an expensive mistake and you've got yourself away from a potential 'nightmare'

I'd contact card company, I know some one who got £1000's back after his wife left him and went on spending spree with his card.
The bank reversed the charges. So I really can't see why you can't get them to refund the cash. No way would I let £500 go. Hell no. Hopefully they sell the car then you can take it to court

What they paid for the car is no concern of yours really... Of course they bought it for less than they are selling it for... It's not that new of a concept
The car could be 110% perfect... If I was you I would get the car inspected by someone **** hot, do all the relevant checks and if all 100%.... What's the problem? If it's not 100% to your liking then you may just take it on the chin and loose the 500....
You are in for 500 quid now, I would at least get the car inspected and not just loose it because you have been turned off... You really have lost all fighting power by the info in this thread imo

To the Op again, forget about courts as that will just take ages and will cost you more money with no guarantee that it will be found in your favour. Spend a few spare hours every week and protest outside their premises with your family and friends. It won't take them long to pay back your money!

There must be a sign saying deposits are non refundable or it must be obviously printed on a deposit receipt.
Also with warrantys , traders must disclose all of it wether it's on a sign,receipt or verbally.
I have many friends in the trade.
Most I know have 2 signs in there offices....warrantys are on a 50/50 basis and deposits are NON refundable

There's a lot of rubbish being spouted in this thread - what exactly has the dealer done wrong?
As I said before I am aware they have a bad rep but there is no evidence to suggest they are bad in this instance.
So called dodgy sales techniques are employed by everyone nowadays, from tesco's 3 for 2 to DFS's never ending sales. Try walking into any car main dealer on the last day of the month and watch the things they try to get an order from you.
Just get the car inspected, it could be the best example in the UK, or walk away.

I disagree. Finding out a company you are about to enter into a contract with are a bunch of crooks with an extensive history of what can only be described as fraud, is grounds not to enter a contract with them and could warrant a return of any monies paid.

Maybe they don't have to do this but according to the OP the car was only held for an hour of business for £500. Morally the right thing to do is to hand back the deposit,it's not like they held the car for a week and lost out on potential sale of the car.
I'm also not saying that the 'other' customer who offered £500 over the asking price wasn't a genuine customer but it does 'sound' like a short con was being played to pressure the OP into leaving a deposit. Car is described as having no modifications, but as stated on a previous page, car has modifications. Which then can warrant the buyer not being able to get insured.
This is just one of the flaws in the Cheshire Performance plan at the moment. The fact they have a history of fraud is another.

End of the day the OP has paid a deposit... He didn't do his research first.... He did his research after commiting to buy... Now he has heard bad stories... That is no grounds for refund of deposit.

If the inspection comes up clean then fair enough, either go through with the purchase or walk away from your deposit. However, if the inspection picks up any faults or aftermarket parts that were not mentioned during the sale then you get your £500 back and move on.
