Well, seems everyone jumps to (the usual) conclusions.
Admittedly the nature of the post didn't help BUT:
I'm overtaking on a 3-lane hill (dual my side) - not screaming up there.
One of the cars is that 350D who decides to put his foot down - about 200 yards from the top of the hill, where the road goes back to 2 lanes.
I'm actually in front of him but I can't/won't carve him up.
I'm stuck - there's a few cars behind me, and the Classic in front with the gap closing rapidly.
So I opened it up to get into the safest place and overtook the scooby.
A case of a driver determined not to be overtaken, not one determined to overtake.
And I know which is the more likely to cause an accident.
Anyway, apologies for giving people the opportunity to form a completely wrong impression without asking about the circumstances.
Seems that I'll have to go back to my more expansive form of posting so that there's absolutely no loose ends to unravel.

Yep, unfortunately and fairly often certain types of people come on forums and post an account of an event expecting 'tea and sympathy' from all and sundry and then they have to furiously back pedal when others see and point out shortcomings in their own driving.

You mean by sitting in the inside lane he was refusing to be overtaken?
Perhaps he thought you were being a **** by leaving it so late before deciding to pull in where the lanes merge into one

200 yards is of course not a problem - about 6 seconds at 60mph, most drivers can manage that.
And of course it doesn't take half that to overtake when a Subaru's put into 3rd .
Ironic thing is that if he'd have been a petrol one he'd have been quick enough for me to get in behind him.

So this is how it reads (unless I've got it totally wrong), you are proceeding uphill in the overtaking lane (middle of three) with a 350D that you are passing to your left and a scooby in front of you, i.e. also in the overtaking lane.
And you overtake the scooby?
Is that how it happened?

No the ironic thing is you don't know what you're talking about. Several of BMW's diesels perform better than their petrols outside of the M cars in terms of rolling real world performance and anyway what is a 350D?
