mate got caugh speeding?

Default mate got caught speeding?

doing 93 and he already has 3 points but he willbe two years past in 10days which means he will have 12 points then,

now if he was give 6 points when it goes to court would he lose it as he only had 6 points to play with at the time or would he keep it has he will have 12 points at the time of the court date?

because he only aloud 6 points now he will get a ban mate as they will look at the date of offence an date from when 2 years was set at. if he was aloud up to 12 he would only get 3 points for his ofence. anything over 30mph of speedlimit is an instant ban. think best thing is to just kiss **** in court an see mate

When did it change so that its an instant ban for doing 30mph over the limit, ie i didnt realise 90 in a 60 was an instant ban, at least it wasnt 12 months ago. Not trying to have a go just wondered if the law had changed.

For as long as I have been driving (20 years this year) that has been the case - I had a mate who was warned by the feds for doing 105 on the motorway, but because he ate lots of humble pie they wrote him up as doing 97 so he got 6 points and not a ban.

I thought 6 points in first 2 years meant licence revoke (not ban) so he would have to retake test?? Which he could do straight away if he wanted

Dunno about the ban for 30mph+ though

with the 6 points in 2 yrs he might be lucky as it will go from the conviction date and not the offence date. so if the conviction happens after these 10 days then he will have 12 points and should be fine. as for the ban because of the speed then i dont know.

I got done for 99 in a 60 the police that pulled me made it clear that if i had been 1mph faster I would have got an instant ban.
I ended up getting a ban anyway cos it was on a B class road and i'm in scotland which i hear is worse in the court system for speeding.

One of my friends was caught doing 93 in a 60 and 97 in a 70 within a few weeks of each other, but he only got banned due to accumulation of points.

But regardless the court system is a joke so anything goes

The date on the paper part of the license is the offence date though.

i reckon it will depend if there stupid enough to work out dates of conviction to the 2 year law thing then might get away with the points an no ban. i got a ban for no insurance because of this an got 6 points but then a month later dvla rang an said i should not have been because i passed my bike test before the law changed in 2004 so i got it back with 6 points on an was aloud upto 12. the courts dont know there own laws. if 2 people where insured u could try an say that dont know who was driving on the day but thats only if it was a speed camera with a letter through the door

it goes from the date of the offence.

I had 6 points and i got stopped doing 104 on the motorway, when i got to court i pleaded for my license etc (due to work). They said that if they give me 6 points then i'll be banned for 6 months due to 'totting up', i told them that 3 of the points had expired and they told me not at the time of the offence. There was a women there (not a magistrate/Cps) with a computer bringing up all the info.

In the end i got a 14 day ban which was better than 6 points, but they were willing to give 6 points and sort offered me the best option due to pleading guilty and being honest with them and generally kissing as much *** as possible. I'm led to believe that anything reported over 98 is a court appearence, but it is a myth about instant bans for 30mph over the limit.

Yeah, total myth. I got caught doing 130 in a 60 but only averaged 106 up in Scotland. Went to court 10 feb 2003 and got six points and a £500 fine. Elgin sheriffs court I think they called it. Very lucky to keep my licence. Even made it into the local rag . **** knows how I got awaywith it, but think the fact I ate lots of humble pie and wore a suit to court may have helped. Also, when I got pulled I was very polite and accepted the fact I'd been caught. The statement written by the police is very important in court. So if you don't get anti they should be ok. Start gobbing off and trying to be clever asking for proof of calibration will just **** them off. Besides it'll be your solicitors job to ask them questions.

I think alot depends on the officer, i got pulled for 101mph and he gave me a talking to i got a ticket £60 and 3 points the ticket even says 101mph

I'm sure its down to officer discretion, I also got copped going northbound A1 @ more than 30 over the limit. 3 points + £60.

I suppose a lot depends on the evidence they have. If they have video evidence it is difficult to apply some judgement on behalf of the copper, but if they are working on a calibrated speedo and 2 coppers as witnesses they could have a chat and come up with something.

As others have said, the date that matters is the offence date, so it is almost certain that the DVLA will revoke the license back to a provisional, and then it means a full rest of the theory and practical tests.

MY BOY GOT 6 POINTS IN THE FIRST YEAR OF DRIVEING HE GOT 14 DAY BAN BUT THEY DIDENT REVOKE HIS LICENCE GET A GOOD SOLICITOR AND KISS ARE WHEN IN COURT

ive heard u can take a day course to keep a license or reduce points etc. anybody done this. ive never asked about it

yeah my cuz was going to fast to a T junction and hit a car witing to turn in and got give that course to keep his license,

as for the 30 mph over the speed limit my mate got caught doing 112mph on a 70 and got 6 point and £500 fine

iv got no point aswell but one night about 3:30 in the morning blasting up an empty A road (in a saxo ) poilce car and van having a chat by the llooks of it in a car park at the side of the road
i went past then doing over 110mph but didnt see them till i was past them then just slowed down till the caught up and pulled me over but didnt get a fine or anything as they said they didnt have a speed gun,

but i thought four cops too me would have stood up in court, then again the would have to explain why four of them were sitting in a car park at the side of the road,

just my car looked over and had to hand docs in, they fobbed me off with a **** story to why they were in that car park aswell what ***** haha

my mate doesnt seem to bothered today he says he see what will happen,

but if he does get a ban he wants me to put a biggr engine in his car youths of today

the offence date and conviction date are different and the conviction date is when you get done for it. they could be funny and say its the offence date but the conviction is spent after (x) amount of time after the conviction date. not the date of the offence. i deal with this day in day out.

I got pulled at 100.9mph almost 10 years ago. Went to court and was told that between 30 and 31 mph over the limit - whatever the limit - it was grey area and subject to magistrates discretion. Over 31mph over limit is instant ban.

I ended up with 6 points and a 500 fine.

if ur on a 6 point licence in ur probation period. and u get 6 points. licence is revoked and the driver must take his test again. this is under the New Drivers Act 1997.

103 in a 60 in Wales. First offence in 12 years= Ban 28 days £235 fine.

yes that is correct bravo. but what i am saying is the points apply to your licence on the conviction date and not the offence. so the offence can be within 2 yrs but if the conviction date is over 2 yrs then he will have a full 12 points.

u have to be convicted of the crime before it can apply and be taken against you,

im not trying to argue im just trying to tell you the truth but obviously that dont matter.
