Thread resurection - FAO H4RDY P1
Being as the original thread seemingly has been lost to the cyberbeasties, I would like to let you all know what has been happengin behind the scenes with regard to Pete Hardy from Sheffield ripping me off when I brought a turbo, s/h from him in August last year.
It has gone to court and he has lost. He lost due to the fact that he did not bother to contest the issue. I was given judgment by the court and now need to getthe Bailiffs involved.
Several pieces of new information have come to light since the last post, these are:

Now both together suggest that he knew that the turbo was goosed and then went and brought himself another one, albeit a 20g.
I ask you to look at the thread that I started on the MLR
I have an opinion and I am going to express it - Page 4 - Mitsubishi Lancer Register Forum
and give me your opinion, I know some of my posts have been somewhat less than mature but they are retaliatory to what has been posted against me, to speak to a child, you must first come down to the child's level etc - this is only to make them understand, the poor things

OH dear here we go again,this guy cant even send me the turbo back for a refund !!,as its not even in tact anymore ,he has been harassing me on any forums he can,i have offered for him to send me the turbo back to me as it was when i sold it but he is not willing to do this!!,
He will probalbly now go an and on about " im a soldier in iraq"

Does this really need to be brought up again on here???
You say that it went to court and you won, so why do you need to comment on the matter on here again??
Pete has says he has offered to take back the turbo for a refund..

Where did you get this from, Pete has not offered to give me my money back, all that has been said is for me to send him the turbo so he can look at it himself, he has not offered a refund. He has said that if it still together he would have given me my money back but now cannot, he has never offered me a refund, and he certainly didn't when he has had the chance to. His most frequent statement is NO, I will not give you a refund

i don't know anything about this sale but i would have thought if the court have gone with the agreeved party and the balifs are now to be involved then its sorted.
i don't understand why a refund needs to be offered or a turbo needs to be returned its nothing to do with the buyer any more (they won) just the seller and the balif. if its returned and refunded who is paying the court costs ?
balif is appointed by the court so leave it to them thats why you pay court costs.
I have nothing against the buyer or seller as i have said i don't know anything about it but do we really need more negs on sc ?

I remember this thread some months ago and I see that Smiffy has now taken Hardy through the County Court and Smiffy tells us he has Judgement. Well done.
Scoobynetters need to be aware of any individuals or companies that do not conduct themselves in a satisfactory manner.
I guess the next step is bailiff enforcement but debtors are given 28 days to clear the debt before the bailiff is involved. A wise debtor in Hardy's position, if he had an unblemished record might want to use the 28 day breathing space to keep his record clear and comply with any Court Order. From reading the MLR thread which I think is an unfortunate farce and should never have happened, it would appear Hardy has not the least intention in complying with the Court Order.
Any payment from the debtor would be direct to the Court, whichever Court that might be but the debtor, Hardy, will have a copy of that Judgement along with an order for costs. Now is too late for ridiculous talks about returning turbos etc.
The court will instruct the bailiffs and in Smiffy's position I would ensure that happens sooner rather than later.

Tell you what, just read some of that car crash over on MLR and I don't really know who to believe. I am however F*CKING sick of hearing you bleating on about being a poor soldier serving in iraq blah blah. No one gives a f*ck. It doesn't mean you have less reason to be ripped off than anyone else. Its your job, get over it!!!!
