Quick question about GATSOs
#2
If a company car is caught on GATSO, can the company say that they don't know who was driving at the time? If they do so, and they pay the fine - what heppens to the points?
Any help would be greatly appreciated.
Thanks

The points can be given (at the discretion of the magistrate) to the company owner or in the case of limited companies, the company secretary/director.
There was a case involving a certain football team who 'forgot' which one of its talentless over-paid tosse...I mean players was driving one of their fleet cars (his 4 Ferarris must have been in for service that day ). Director of said club aquired himself some points and a fairly hefty fine.
Edited coz I can't spell when I've just woken up

Thanks Stuart.
This is actually for the brother of a workmate. His father and brother co-run a company so he was wondering if they could get around his brother's speeding ticket by claiming that it was someone else in the company. Although in my opinion if they ask how many people there are in the company and the answer is 2 - they are in trouble.
DOH !!

Hmmm, interesting one this. So, if the company owner/secretary/director gets the points and enough of his/her employees fall foul of the dreaded Gatsos, he/she will end up with enough points to be banned under the totting-up rule. What happens after that? Would every subsequent offence result in the company owner/secretary/director being prosecuted for driving whilst disqualified, driving without a licence or insurance, or what? Surely, if the company owner/secreary/director doesn't know and can't find out who was driving, then it's up to the police to PROVE who was driving. Or does the principle of innocent until proven guilty not apply to motorists?

In theory yes, but as I said it is at the discretion of the magistrate so the licence will not always be endorsed. The idea is that the company owner/secretary/director makes sure he knows who's driving his/her cars.
Strangely enough, the first time an owner/company secretary/director aquires points this way, it is always the last.

So.......we should all become part time employees of a company called erm.. say Scoobynet which notionally owns 4000 cars (obviously insured by Rum).
Company directors are a couple of the aforementioned "employees" dear old grannies who have never held a licence.

Is it legal to name your cat (for example) as a company director? Also this system seems open to abuse for disgruntled employees to get their bosses disqualified, surely this can't be right in a (supposed) democracy?

Woody,
I'm afraid to tell you the ECHR Article 6 'loophole' which I assume you are referring to has been closed by the law Lords.

What happens if the MD of a company doesn't drive, but has cars owned by the company for the use of it's employees? Surely in that case his/her license can't be endorsed??
