ADVICE! please! Police laser this morning!

Unhappy ADVICE! please! Police laser this morning!

Hi all

i was minding my business on the way to work, orad drops from 60mph to 30mph is long and straight, as i went into the 30pmh a Policeman with a hand held gun, tube about a pringle pot size zapped me, i was doing an indicated 35mph, he looked behind his shoulder to something i couldnt see but didnt wave of gesture in my direction

whats the vote would he have stopped me there and then?

Thats what Policemen do. Its always possible that you could receive an NIP, but I wouldnt expect it, even if you were going fast enough to nick.....

if its a handheld device i beleive they have to stop you as it doesnt take pictures.

If it was exactly 35 on your speedo the chances are you were only doing 32 if that.
They dont have to pull you over there and then.

Sit tight and expect a NIP within the next 14days, if you don't get one - you should be ok.

when i was caught speeding and the guy had a handheld gun he stopped me there and then.

You are allowed 10% + 2 mph, so they wouldn't bother stopping you at 35. Also as already been said your speedo will over-read.

Bit of a myth that one. That is only a guideline not a rule. Technically 31 in a 30 is over the limit and they could do you although it would be difficult for them to prove it with that much accuracy.

Myth that traffic officers have confirmed? It was 10% + 3 anyway.

guidelines i found on the net after a simple google search

"85th percentile speed at or approaching collision hot spot 85th percentile speed at or above ACPO guidance (10% plus 2mph) for free flowing traffic (excluding rush hour). Partnerships must have a strategy to move thresholds to the ACPO guidance level by April 2005"

You're guilty of speeding once you travel at 1 mph over the posted speed limit, and for that reason it's referred to as an "absolute offence". If a police officer tells you that they won't pull you over on a motorway at under 85 mph then that'is either their personal opinion or the policy of their constabulary. This is why they won't need any changes in legislation to introduce "zero tolerance".

As said the 10% +2 is a guideline, a guideline isn't a rule or law and as such can be ignored. It is why they can zap you from 2k away with a laser even though the guidelines say they shouldn't.

yeah that above is def right.. The thing i read does state afterwards that those guidelines do not overrule police discretion. E.g a police officer could prosecute for 32 outside a busy school etc if he believed it was appropriate. These guidelines are meant to be followed though as it is part of the governments policy towards transparency as well as consistency across the board.

If it helps put your mind at rest a bit, just over a month ago i was in the exact same situation you are in. I was driving my brother through a local town and was chatting to him. I spotted a mobile van aiming right at me.. there were no other cars on the road at the time so it was obviously pointing at me.. looked down at the speedo and i was doing either 34 or 35. I was on holiday for 2 weeks so expected to have a nice present from the scamera department.

Outcome.. Nothing. I haven't been done for it and im glad as i genuinely am really careful with my speed and would be fuming if one lapse of concentration caught me out!

If you weren't pulled at the time chances are your fine. Not worth the hassle for 35 unless it was a slow day. Chances are your in the clear.

Thanks Chaps i feel a bit better, a couple of guys at work go the same way and one said he did see them with a car pulled up so hopefully i am in the clear!
