Tegtmeyer (the pedestrian) miraculously escaped alive because the dent in the side of the Subaru caused by the crash created a hollow space that allowed the vehicle to roll over him without crushing him to death. Neither vehicle was carrying any passengers, and both drivers escaped with only minor injuries.
Looks like the pedestrian was actually! Pronounced dead at the scene, revived on the way to hospital. Then on 2nd June he was in a serious condition. If you scroll down there is an article dated 3rd June saying man killed in car accident.
